521.2000 RESOLUTION AUTHORIZING SETTLEMENT OF PENDING ARTICLE 7 REAL PROPERTY ASSESSMENT CASES COMMENCED BY MARTIN’S FOODS OF BURLINGTON, INC. RESOLUTION NO.: 521, 2000 INTRODUCED BY: Mr. James Martin WHO MOVED ITS ADOPTION SECONDED BY: Mr. Daniel Stec WHEREAS, Martin’s Foods of Burlington, Inc. previously commenced Article 7 Real Property Assessment Review cases against the Town of Queensbury for the 1993/94, 1994/95, 1995/96, and 1996/97 assessment years, and WHEREAS, the Town Assessor has recommended a settlement proposal to the Town Board and the Town Board has reviewed these cases with Town Counsel, and WHEREAS, the Glens Falls City School District has been informed of the proposed settlement and the School District has advised that it has no objection, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves the settlement of the pending Article 7 cases against the Town of Queensbury by Martin’s Foods of Burlington, Inc. for the 1993/94, 1994/95, 1995/96, and 1996/97 tax years in accordance with the following revised assessment values: Parcel - Tax Map No.: Tax Year: Revised Assessment Hannaford Grocery Store 1993-1994 $4,200,000 53 Quaker Road 1994-1995 $4,200,000 Queensbury, New York 12804 1995-1996 $4,200,000 Tax Map No.: 105-1-4.21 1996-1997 $4,200,000 and BE IT FURTHER, RESOLVED, that refunds without interest shall be paid to Martin’s Foods of Burlington, Inc. as a result of this settlement, and BE IT FURTHER, RESOLVED, that the Town Board accepts Martin’s Foods of Burlington Inc.’s discontinuation of its Article 7 Real Property Assessment Review cases against the Town of Queensbury for the 1997-98, 1998-99, 1999-00 and 2000-01 assessment years, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Assessor and/or Town Counsel to execute settlement documents and take any additional steps necessary to effectuate the proposed settlement in accordance with the terms of this Resolution. th Duly adopted this 18 day of December, 2000, by the following vote: AYES : Mr. Stec, Mr. Brewer, Mr. Martin, Mr. Turner, Mr. Brower NOES : None ABSENT: None
