176.92 RESOLUTION AUTHORIZING SUPERVISOR TO SIGN CONTRACT BETWEEN THE CITY OF GLENS FALLS, THE TOWN OF QUEENSBURY AND THE BROAD STREET CAR WASH, INC. RESOLUTION NO. 176, 92 , Introduced by Mr. Nick Caimano who moved for its adoption, seconded by Mr. Pliney Tucker. WHEREAS, the Town Board of the Town of Queensbury and Broad Street Car Wash, Inc., previously entered into an agreement concerning a hook-up by Broad Street Car Wash, Inc. to the Glens Falls sewer facilities, and WHEREAS, the Town of Queensbury and City of Glens Falls also entered into an agreement concerning the hook-up by Broad Street Car Wash, Inc. to the Glens Falls sewer facility which Broad Street Car Wash, Inc. was also to execute, and WHEREAS, Broad Street Car Wash, Inc. raised certain concerns about the agreement proposed between the City of Glens Falls, the Town of Queensbury and Broad Street Car Wash, Inc. and the agreement, therefore, was revised, and WHEREAS, the Town Board of the Town of Queensbury has previously adopted resolutions approving both the original agreement between the City of Glens Falls, Town of Queensbury and Broad Street Car Wash, Inc. and the agreement between the Town of Queensbury and Broad Street Car Wash, Inc. since that agreement has been revised, the Town Attorney has advised that it is necessary to have Town Board review and, if acceptable to the Town Board, approval by the Town Board of the new agreement, NOW, THEREFORE, BE IT RESOLVED, the Town Board of the Town of Queensbury after reviewing this matter hereby approves the new agreement between the Town of Queensbury, City of Glens Falls and Broad Street Car Wash, Inc., the same being presented at this meeting and hereby further authorizes and directs the Town Supervisor to execute the same on behalf of the Town of Queensbury and take such other and further steps as may be necessary to finalize the agreement between all the parties and take such action as may be required or necessary to accomplish the purposes of the agreement.
