BOH21.92 RESOLUTION TO SET PUBLIC HEARING ON APPLICATION FOR VARIANCES OF SANITARY SEWAGE DISPOSAL ORDINANCE FOR TOM MC GOVERN & DAN FURLONG RESOLUTION NO.: 21, 92 INTRODUCED BY: Mr. Michel Brandt WHO MOVED ITS ADOPTION SECONDED BY: Mr. Pliney Tucker WHEREAS, the Town Board of the Town of Queensbury is, by operation of Law, the Local Board of Health for the Town of Queensbury and, as such, is authorized under Chapter 136 of the Town of Queensbury On-Site Sewage Disposal Ordinance to issue variances to such Ordinance, and WHEREAS, Messrs. Tom McGovern and Dan Furlong have applied to the Local Board of Health of the Town of Queensbury for a variance from certain standards of the Town of Queensbury On-Site Sewage Disposal Ordinance set forth in Chapter 136-7, Section A, such standard providing that: "Individual sewage disposal systems shall comply with the standards of this Article and with the most recent editions of the Waste Treatment Handbook - Individual Household Systems, New York State Department of Health, and Institutional and Commercial Sewage Facilities, New York State Department of Environmental Conservation. In the case of conflicts among these standards, the most restrictive shall apply." and therefore, for a variance from certain standards of the latest edition of the New York State Department of Health Wastewater Treatment Standards - Individual Household Systems - Section 75- A.8(h)3(vi), such standard providing that: "The separation between the outside edges of seepage pits shall be three times the effective diameter of the largest pit. This separation is measured as the undisturbed soil between pit excavations." and WHEREAS, Messrs. McGovern and Furlong have indicated a desire to place the seepage pits 11' from each other, rather than placing them at the mandated 24' distance; NOW, THEREFORE, BE IT RESOLVED, that the Local Board of Health for the Town of Queensbury will hold a public hearing on September 28th, 1992, at 7:00 p.m., at the Queensbury Activities Center, (reasonably accessible to persons with mobility impairment) 531 Bay Road, Town of Queensbury, Warren County, New York, to consider the application for a variance of Messrs. Tom McGovern and Dan Furlong, to place the seepage pits 11' from each other, rather than placing them at the mandated 24' distance; on property situated at the corner of Indiana and South Avenues, Town of Queensbury, New York, and bearing Tax Map No.: Section 127, Block 11, Lot 1, and, at that time, all persons interested in the subject thereof will be heard, and BE IT FURTHER, RESOLVED, that the Town Clerk of the Town of Queensbury be and is hereby directed and authorized, when in receipt of a list of neighbors within 500 feet of the subject property, to publish and provide Notice of said Public Hearing as may be required by law, and authorized to mail copies of said Public Hearing Notice to the adjoining neighbors.
