1976-10-20 ~(, MINUTES of the public hearing of the Zoning Board of Appeals held October 20, 1976 at 7:30 P~M. There were present: George Kurosaka (Acting Chairman) Charles Sicard Sjoerdje Richardson being the members of the Board. The meeting was called to order by Mr. Kurosaka. The Minutes of the last meeting were approved. OLD BUSINESS - None NEW BUSINESS: Variance #459 - John D. Buecking, East Side Ridge Road - to allow domestic livestock on 7-1/2 acre lot in an R-3 Zone on the pro- perty situated at east side of Ridge Road. Mr. Buecking was not present and the board stated they would go back to this Variance when he arrived. "--- Variance #460 - Roland C. Mandigo - to enlarge a non-conforming use in R-3 and R-4 Zone on the property situated at Luzerne Road. Mr. Mandigo was present and stated the addition would be to his existing building. There were no appearances for or against. The Town of Queensbury Planning Board approved without comment. Charles Sicard made a motion and it was seconded by S. Richard- son. as follows: RESOLVED, that Variance #460 be approved as a reasonable use of the land. Approval unanimous. Variance #461 - Peter Harris Clothes - to place a 5 ft. by 20 ft. sign on the edge of canopy in lieu of the required l5 inch projection from the face of the building on the property situated at Route 9, Northway Plaza. ~ 91 -2- Requested to postpone this for one month. Variance #462 - John R. Girard, d/b/a Carbide Sharpening Ser- Vice - to enlarge a nonconforming use in an R-3 Zone on the property situated at south side of Corinth Road. Mr. Girard was present. Mrs. Helen Fuglister, who lives 800' away from this business was present in objection to this variance. She stated that the bus- iness is very noisy and if he was allowed to build, it would only add to the noise problem. The Town of Queensbury approved without comment. Mr. Sicard made a motion to approve the application and it was seconded by S. Richardson as follows: \...... RESOLVED, that Variance #462 be approved as it is in conformance with the Town of Queensbury Planning Board and Warren County Planning Board. Variance is also approved with the following stip- ulations: Building is to be finished with board and batton on the addition and stucco on the blocks. To have a lawn in the front, shrubs in front of the building with lawn to the road. Variance #459 - John D. Buecking - to allow domestic livestock on 7-1/2 acre lot in an R-3 Zone on the property situated at east side of Ridge Road. Mr. Buecking was present and stated this land was across from the Butternut Hill Development. He stated the reason for his putting horses on this land would be for recreational purposes only for his children to ride. There would be no more than six horses. He also stated he was in the process of purchasing this property. The pro- perty has one house, two out buildings with a barn which is 40 x 20. The following people were present in objection to this applica- tion: Walter Dykeman, who lives up the hill on Chestnut Ridge said he ~ 11 -3- was opposed because of smell, flys, etc. Dr. Lee said he was confused over the notice from the Zoning Board saying "Domestic Livestock." Said he would not object to a couple of horses but would not want six horses. Mr. Charles Adams, Chestnut Ridge Road, against having any horses at all. Mrs. Pauline Adams, Chestnut Ridge Road, also opposed to hav- ing any horses there. Mrs. Loretta Anderson, Corner of Chestnut Ridge and Ridge Road, in objection. No horses at all. "Barbara Houghton, Chestnut Ridge, \Vas opposed because she said it would depreciate the value of her property. Gerald Noonan, Chestnut Ridge Road, opposed to having any hor- ses. '- Letters were received from the following with no objection.: Mrs. Louise Miller, Mrs. Bishop and Victor Bishop and Earl Ellsworth. Mrs. Richardson made a motion, seconded by Charles Sicard: RESOLVED that Variance #459 - John D. Buecking, be disappro- ved in view of the fact that the neighborhood is now residential. Variance #463 - George Pfeiffer, Glendale Drive, Glens Falls, C-2 Zone, ~ to enlarge a non-conforming use on the property sit- uated at Glendale Drive. Mr. Pfeiffer was present. No one appeared for or against this variance, and the Town of Queensbury approved without comment. Charles Sicard made a motion to approved the application and it was seconded by Mrs. Richardson as follows: '- RESOLVED, that Variance #463 - George Pfeiffer, be approved as it concurs with the Town of Queensbury Board. .1 C Lf 1'9 -4- The public portion of the meeting was closed. Mr. Andrew VonDeak and Bruce Keenan of the Pyramid Com- pany asked the Board for some special time to be heard and to present the following. Mr. Robert Stewart, attorney for Py- ramid Company was also present. Mr. Keenan stated they had previously gone before the Zo~ng Board concerning the new addition and wanted to know if the present plan conforms closely enough with the original plan instead of going through more plans. He further stated that Sears would be in the Mall. He does not think that the plan they are now proposing is changed much from the original plan and ask the Board that because of the winter weather coming would ask the Board that they not have another plan made up. '-- Mr. Bob Eddy, Chairman of the Beautification Committee has not been contacted regarding the new part of the building. A building permit also needs to be granted. Charles Sicard said he would like to see what the Beautifi- cation Committee decides ,tomorrow night. Mr. Keenan asked the board if they would approve the bui1d- ing permit and leave the rest to the Beautification Committee. The meeting was again officially opened and on a motion by George Kurosaka, seconded by Mrs. Richardson the following: ''-- RESOLVED that Pyramid Company of Glens Falls go to the Beautification Committee meeting tomorrow night as an advisory on the landscaping and screening of the entire pro- ject and they are to bring that material back to the Zoning Board next Wednesday or Thrusday with their recommendations. In the meantime, the Zoning Board is directing the building inspector to go ahead and grant the building permit. At that meeting, it will be agreed what is to be done and a Certificate of Occupancy will not be issued until everything is done. Also - the plans are not a major deviation from the plans but enough to call for a review (date of plans is September l3, 1976) plus the landscaping. f6() -5.... The motion was unanimous.
