1977-03-16 /3/ MINUTES of the public hearing of the Zoning Board of Appeals held March 16, 1977 at 7:45 P.M. There were present: John Fitzgerald, Chairman George Kurosaka Sjoedje Richardson Charles Sicard Ted Turner being members of the Board. There were also present: Mrs. Edward Willis (League of Women Voters) George Liap" Harold Boynton Lee Coleman (The Post-Star) On a motion by Mr. Fitzgerald, seconded by Mr. Kurosaka, the minutes of the February meeting were approved as read. Old Business: '-- Variance #478 - Sears, Roebuck & Co. - to install nine wall signs in lieu of the allowed one wall sign on the property situated at Aviation Mall, Aviation Road. Robert Stewart was present as representative and Robert Platt from Signs of Progress. There were no appearances for or against this variance. Both Town and County Planning Boards approved. The Board: RESOLVED: Application for Variance #478 be approved conforming with Town Planning Board. This motion was made by Ted Turner seconded by George Kurosaka. Vote: 4 aye 1 naye to approve. Motion carried. Special Permit #47 - Pyramid Mall Co. -(Town Attorney's Legal Opinion) '- Ta1bed until legal action is appropriate. /3;Z -2- New Business: Variance #483 - Walter J. Barthel - to construct a Wood- working Shop and Gift Shop with a 4' x 6' free-standing sign in an R-3 Zone on the property situated at the east side of Ridge Road. There were no appearances for or against this variance. Warren County Planning Board approved. The Board: RESOLVED: Application for Variance #483 be approved and subject in accordance to Planning Board. Restricted only to applicant and present owner. This motion was made by Charles Sicard seconded by Ted Turner. Unanimous decision to approve. Variance #484 - Ralph and Elizabeth Schoenherr - to establish ',-- a non-conforming lot of 25,000 sq. ft. with 40 ft. road frontage in an R-I Zone on the property situated at Cleverdale Road. Public appearance against by Dr. Colegate Philips. Lot too narrow. He rents house for the summer and 40 ft. might devalue his property. Town Planning Board - disapproved 5 naye 2 aye The Board: RESOLVED: Self-imposed hardship. This motion was made by George Kurosaka seconded by Sjoedje Richardson. Unanimous decision for disapproval. Variance #486 - Carmine E. DiCiccio (Queens bury Sunoco) - to place a self-service sign and a changeable price sign on the -- property situated at the Corner of Glen Street and Glenwood Avenue. 133 -3- There were no appearances for or against this variance. .~ Town Board disapproved two signs. Cut down to one two- faced sign. Warren County Planning Board - concurs with Town Board. The Board: RESOLVED: Grant Variance #486 approval with the following stipulations: Sign: 30 by 36 inches - double-faced s·ign with height not exceeding 10 feet. This motion was made by Ted Turner seconded by Charles Sicard. Unanimous decision to approve variance. Special Permit #63 - Turnpike Enterprises, Inc. - to place another Drive-in theater on the property situated at the west side of Route 9. There were no appearances for or against this permit. Town Planning Board - approved of Special Permit #63 with increase of buffer line of 20 feet with no trees cut down. '-- The Board: '- RESOLVED: 1. The use is one specifically enumerated in the district - C-3 2. Such use will not be prejudicial to the character of the area. 3. The Board determines that there is appropriate provision for access facilities adequate for the estimated traffic from public streets and/or highways and that there are pedestrian walkways so as to insure public safety and to avoid traffic congestion. 4. That there are full adequate parking areas and off-street loading spaces, in conformity with the proposed parking requirements of the zoning ordinance of the Town of Queensbury and all other related ordinances. S.. That the 20 ft. buffer is of natural existing growth be maintained along south property line as recommended by Queensbury Planning Board. 6. That such use is of the same general character as, or will not be injurious to, the surrounding neighborhood or district. 7. That such structures are so arranged so as to permit diversification in the location of site qualities while maintaining adequate standards for total health, safety, welfare and convenience. 3tf -4- Proposed screen shall be placed 50 feet from any residential property line.
