Resolutions 1. PB decision Project Description Applicant proposes to complete construction of a gravel mulch path. Proposal is to construct a 300 ft. long, 6 ft. wide gravel path on slopes in excess of 20%. Further, applicant proposes a 40’x 8’ gravel turn around adjacent to the Hudson River shoreline. Applicant Site Plan 77-2012 for this project has since expired. Pursuant to Chapter 179-6-050 of the Zoning Ordinance, hard surfacing within 50 ft. of shoreline shall be subject to Planning Board review and approval. Staff Comments  Location-The project is located at 11 Sperry Road on a 1.48 acre parcel.  Arrangement- The project site has an existing home and a portion of pathway area leading to the shoreline.  Site Design- The board previously saw the pathway plan in 2012 and the application has since expired. The pathway remains the same that is to be about 300 ft long, 6 ft wide and to be made of gravel and mulch.  Building – There is no change to the proposed home or other site elements not related to the path.  Grading and drainage plan, Sediment and erosion control – The plans show the grading to occur with the path area along with the stormwater management. The project involves disturbance of about 8,200 sq ft. The bank stabilization includes Erosion Control matting on areas labeled slope stabilization, a rip rap line slope area towards the water area of the slope including a rip rap outfall. Temporary erosion control measures are silt fencing and a straw bale unit that are to be removed once construction is completed. Seed and mulch are proposed over the entire disturbed area. The remainder of the path 200 ft +/- will consist of a 6 ft wide gravel path, a 2 ft wide rip rap ditch, and a 180 sq ft gravel landing. The project received engineering signoff 8/27/2013.  Landscape plan – The path area is located amongst a tree/ vegetated area on the hill side of the property.  Utility details- no changes to the water supply, septic system or other utilities.   Waivers-Planning staff has reviewed the applicants request for waivers that include items, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.  The waivers requested–Staff finds it reasonable to request a waiver as these items are typically associated with commercial projects, in addition this project had expired and has not changed.  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Summary The project details a 300 ft path to address as a response to an enforcement action for filling within 50 ft of the shoreline.
