283.93 RESOLUTION ADOPTING DETERMINATION OF NON-SIGNIFICANCE OF AMENDMENT TO ZONING ORDINANCE TO CHANGE THE DESIGNATION OF PROPERTY OWNED BY RONALD L. NEWELL AND GARFIELD P. RAYMOND FROM UR-1A TO MR-5 RESOLUTION NO.: 283, 93 INTRODUCED BY: Mr. Nick Caimano WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Town Board of the Town of Queensbury is considering the application for a change of zone by Ronald L. Newell and Garfield P. Raymond, requesting that certain parcels of property owned by said Messrs. Newell and Raymond, bearing Tax Map Numbers 61-1-41.1 and 61-1-44, be rezoned from the current zoning of UR-1A (Urban Residential - 1 Acre) to MR-5 (Multifamily Residential - 5,000 Square Feet), and WHEREAS, as a result of the public hearing and review had on the proposed rezoning, the Town Board is desirous of undertaking a rezoning action which would result in a rezoning of so much of the property bearing tax map number 61-1-41.1 and 61-1-44 as lies and exists 1,000 feet easterly of the boundary line of the affected property lying closest to and west of Bay Road, excepting therefrom however, so much of that area that lies and exists within a DEC designated wetland which area would continue to be zoned UR-1A, and WHEREAS, the action as now proposed has been determined to an unlisted action pursuant to the Rules and Regulations of the State Environmental Quality Review Act, NOW, THEREFORE, BE IT RESOLVED, that the Town Board after considering the action proposed herein, reviewing the Environmental Assessment Form, reviewing the criteria contained in Section 617.11, and thoroughly analyzing the said action with respect to potential environmental concerns, determines that the action will not have a significant effect on the environment, and BE IT FURTHER, RESOLVED, that the Town Supervisor is hereby authorized and directed to complete and execute Part II of the said Environmental Assessment Form and to check the box thereon indicating that the proposed action will not result in any significant adverse impacts, and BE IT FURTHER, RESOLVED, that pursuant to Section 617.15, the Negative Declaration presented at this meeting is hereby approved and the Executive Director is hereby authorized and directed to file the same, as may be necessary, in accordance with the provisions of the general regulations of the Department of Environmental Conservation.
