284.93 RESOLUTION AMENDING ZONING ORDINANCE TO CHANGE THE DESIGNATION OF PROPERTY OWNED BY RONALD L. NEWELL AND GARFIELD P. RAYMOND FROM UR-1A TO MR-5 RESOLUTION NO. 284, 93 INTRODUCED BY: Mr. Michel Brandt WHO MOVED ITS ADOPTION SECONDED BY: Mr. Nick Caimano WHEREAS, Ronald L. Newell and Garfield P. Raymond, petitioned the Town Board of the Town of Queensbury for a zoning change of their property (Town of Queensbury Tax Map No.'s: 61-1-41.1 and 61- 1-44) from the current zoning of UR-1A (Urban Residential - 1 Acre) to MR-5 (Multifamily Residential - 5,000 Square Feet), and WHEREAS, on the 26th day of January, 1993, the Town of Queensbury Planning Board recommended approval of the petition, and WHEREAS, the Warren County Planning Board also recommended approval of said petition on the 20th day of January, 1993, and WHEREAS, a public hearing was held on this matter on May 3, 1993, and WHEREAS, as a result of the public hearing and review had on the proposed rezoning, the Town Board is desirous of undertaking a rezoning action which would result in a rezoning of so much of the property bearing tax map number 61-1-41.1 and 61-1-44 as lies and exists 1,000 feet easterly of the boundary line of the affected property lying closest to and west of Bay Road, excepting therefrom however, so much of that area that lies and exists within a DEC designated wetland which area would continue to be zoned UR-1A, and WHEREAS, the Town Board of the Town of Queensbury has made a determination that the rezoning will have no significant environmental impact, and WHEREAS, the Town Board of the Town of Queensbury has considered the conditions and circumstances of the areas to be rezoned, NOW, THEREFORE, BE IT RESOLVED, that the Town of Queensbury Zoning Ordinance is hereby amended to re-zone to MR-5 (Multiple Family Residential - 5,000 square feet) so much of the property bearing Town of Queensbury Tax Map No.'s: 61-1-41.1 and 61-1-44 (property owned by Ronald L. Newell and Garfield P. Raymond) as lies and exists 1,000 feet easterly of the boundary line of the affected premises lying closest to and westerly of Bay Road and thereby authorizing in this area, all uses permitted under §179-18 of the Code of the Town of Queensbury, excepting therefrom however, so much of that area that lies and exists within a DEC designated wetland which area would continue to be zoned UR-1A, and and 2 BE IT FURTHER, RESOLVED, that the Zoning Map for the Town of Queensbury is hereby amended to provide for the rezoning of said lands, and BE IT FURTHER, RESOLVED, that the Town Clerk shall, within five (5) days, direct that a certified copy of said changes be published in the Glens Falls Post-Star and obtain an Affidavit of Publication, and copies of this resolution and the aforesaid notice shall be circulated to the various agencies and departments as may be required by law or regulation, BE IT FURTHER, RESOLVED, that this amendment take effect ten (10) days after publication in the official Town newspaper.
