341.94 RESOLUTION ACCEPTING DEDICATION OF A PORTION OF HUNTER BROOK LANE (IN THE CROSS ROADS PARK SUBDIVISION) RESOLUTION NO. 341.94 INTRODUCED BY: Mr. Nick Caimano WHO MOVED ITS ADOPTION SECONDED BY: Mrs. Carol Pulver WHEREAS, BAY ASSOCIATES has offered a deed to dedicate to the Town of Queensbury a portion of Hunter Brook Lane, which is more particularly described in the survey map presented at this meeting and the original deed being presented to this meeting, and WHEREAS, Paul H. Naylor, Superintendent of Highways of the Town of Queensbury has advised that he finds the road to meet the appropriate Town of Queensbury specifications, with the exception of application of the final black-top surface, and, with regard to the final blacktop surface, the Highway Superintendent has indicated that the amount of $6,000.00 is a reasonable escrow amount. WHEREAS, Thomas K. Flaherty, Superintendent of Water of the Town of Queensbury, has advised that he has made an inspection of water mains and appurtenances in said road proposed for dedication and finds that the installation is in accordance with the requirements of the Town of Queensbury Water Department, and WHEREAS, the form of the deed and title to the road offered for dedication, as well as the certified check in the amount of $6,000.00 and Escrow Agreement promising to complete the road, have been reviewed and approved by Paul B. Dusek, Town Attorney for the Town of Queensbury, NOW, THEREFORE, BE IT RESOLVED, that the aforementioned deed for dedication of the said road be and the same is hereby accepted and approved, that the Town Supervisor is hereby authorized to execute, sign and affix the Town seal to any and all documents necessary to complete the transaction, and that the Town Clerk is hereby authorized and directed to cause said deed to be recorded in the Warren County Clerk's Office, after which said deed shall be properly filed and maintained in the Office of the Town Clerk of the Town of Queensbury, and BE IT FURTHER, RESOLVED, that the amount of $6,000.00 and Escrow Agreement wherein the developer promises to complete the road within 2 years be accepted and the check immediately deposited and held or expended in accordance with the Agreement between the developer and the Town, and BE IT FURTHER, RESOLVED, that the Town Clerk retain and file said Letter of Credit and Escrow Agreement, and that the road be hereby added to the official inventory of Town Highways, to be described as follows: Road Number: 500 Description: Beg. at Blind Rock Road Northerly ending at Cul-De-Sac Name: Hunter Brook Lane Feet: 444' Duly adopted this 11th day of July, 1994, by the following vote: AYES : Mr. Caimano, Mrs. Pulver, Mrs. Monahan, Dr. Wiswall, Mr. Champagne NOES : None ABSENT: None
