CASE PRIME SJOERDJE RICHARDSON CHARLES SICARD BARBARA STONE - POST STAR ABSENT: A. MATHER REED MOTION TO APPROVE MINUTES OF NOVEMBER 19, 1980 BY MR. TURNER, SECONDED BY MR. SICARD. MOTION CARRIED UNANIMOUSLY. SPECIAL PERMIT NO. 93 - CHAMPLAIN OIL COMPANY C-3 ZONE WEST SIDE ROUTE 9, NORTH OF EXIT 20 OF THE NORTHWAY. MR. TONY KERANCE AND MR. JOHN MITHCHELL PRESENT. CITCO DISTRI- BUTOR UNDER OPTION TO BUY FROM TEXACO. THIS WILL NOT BE A 24 HOUR OPERATION, MAINLY GASOLINE. THE STORE WILL BE LEASED FOR A SMALL CONVENIENCE MART AND WILL BE OF COLONIÁL ARCHITECTURE. MR. SICARD OFFERED A MOTION TO APPROVE THIS SPECIAL PERMIT, SECONDED BY MRS. RICHARDSON. MOTION CARRIED UNANIMOUSLY. RESOLVED: THE BOARD GRANTED THIS SPECIAL PERMIT IN CONCURRENCE WITH OUEENSBURY AND WARREN COUNTY PLANNING BOARDS. THE BOARD FINDS: 1. THE USE IS ONE SPECIFICALLY ENUMERATED IN THE DISTRICT. 2. SUCH USE WILL NOT BE PREJUDICIAL TO THE CHARACTER OF THE AREA. 3. THE BOARD DETERMINES THAT THERE IS APPROPRIATE PROVISION FOR ACCESS FACILITIES ADEQUATE FOR THE ESTIMATED TRAFFIC FROM PUBLIC STREETS AND/OR HIGHWAYS AND THAT THERE ARE PEDESTRIAN WALKWAYS SO AS TO INSURE PUBLIC SAFETY AND TO AVOID TRAFFIC CONJESTION. 4. THAT THERE ARE FULL ADEQUATE PARKING AREAS AND OFF-STREET LOADING SPACES, IN CONFORMITY WITH THE PROPOSED PARKING REQUIREMENTS OF THE ZONING ORDINANCE OF THE TOWN OF QUEENSBURY AND ALL OTHER RELATED ORDINANCES. 5. THAT SUITABLE PLANTING OR SCREENING HAS BEEN REQUIRED AS FOLLOWS: PER LETTER DATED 12/2/80 FROM QUEENSBURY COMMITTEE FOR COMMUNITY BEAUTIFICATION. '--- S'Çy PAGE 2 DECEMBER 17, 1980 6.
