225.96 RESOLUTION REGARDING UNSAFE STRUCTURE - CORINTH ROAD - MR. HARLEY JAMES RESOLUTION NO. 225, 96 INTRODUCED BY: Mr. Theodore Turner WHO MOVED FOR ITS ADOPTION SECONDED BY: Mrs. Connie Goedert WHEREAS, the Town Board of the Town of Queensbury has received a report from the Director of Building and Codes, Mr. David Hatin, concerning an unsafe structure located on Corinth Road in the Town of Queensbury bearing Tax Map No. 125-3-2, and WHEREAS, the Town Board of the Town of Queensbury has been advised that notice of public hearing was served pursuant to §130(16) of the New York State Town Law and Chapter 60 of the Code of the Town of Queensbury, and WHEREAS, a public hearing on this matter was conducted on May 20, 1996, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury, after hearing from Mr. Hatin and after reviewing the documents submitted in connection with this matter and after conducting a public hearing, hereby determines that the structure is currently unsafe and dangerous and determines that the owner(s) of the structure should immediately start to repair or demolish and remove the structure and that the repair and/or demolition and removal shall be completed within sixty (60) days of service of the Notice of this public hearing, and BE IT FURTHER RESOLVED, that in the event that there is neglect or refusal to comply with the order of this Board to repair or demolish and remove the structure located on the property, the Town Board will take action to have the property demolished and removed and to assess all expenses thereof against the real property on which it is located and Town Counsel is authorized to institute a special proceeding, as necessary, to collect the cost of said action, including legal expenses.
