Dear Peter: At your request, I met with Jeff Mercure of your office and conducted a field visit at 8:15 AM on January 5, 2006 to review the installed Eljen wastewater disposal system for Building No. 1. In my opinion, the system has been installed in substantial compliance with the requirements of the project design drawings and, upon receipt of final approval from the Town of Queensbury, may be backfilled to finished grade. Mr. Mercure noted that the water service line for this building was installed across the 100% replacement area location for this system indicated on the drawings. We understand that this was done in coordination with the Town of Queensbury and that a letter to the Town stating that future possible replacement of this system will be completed by removal of the failed system and replacement at the same location. In our opinion, this is an acceptable approach for potential future system replacement. Notes should be provided on the record drawings which clearly indicate the as-built location of the water line and the intent for future replacement of the system in the event of failure.
