BOH33.97 RESOLUTION APPROVING SANITARY SEWAGE DISPOSAL VARIANCES FOR BYRON RIST AS APPLICANT FOR OWNER LEON W. DAVIS RESOLUTION NO.: 33.97 INTRODUCED BY: Mrs. Connie Goedert WHO MOVED ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, Byron Rist, applicant for Leon Davis, previously filed a request for two (2) variances from certain provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, such provisions being more specifically that requiring that an applicant must apply for a variance in order to have a holding tank and that the holding tank be installed below the grade, and WHEREAS, a notice of public hearing was given in the official newspaper of the Town of Queensbury and a public hearing was held in connection with the variance requests on October 20, 1997, and WHEREAS, the Town Clerk advises that property owners within 500 feet of the subject property have been duly notified, NOW, THEREFORE, BE IT RESOLVED, a) that due to the nature of the variances, it is felt that the variations will not be materially detrimental to the purposes and objectives of this Ordinance or to other adjoining properties or otherwise conflict with the purpose and objectives of any plan or policy of the Town of Queensbury; b) that the Local Board of Health finds that the granting 1 of the variances is necessary for the reasonable use of the land and that the variances are granted as the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the applicant; and c) that the Local Board of Health imposes a condition upon the applicant that he must also secure the approval of the New York State Department of Health; and BE IT FURTHER, RESOLVED, that the Town of Queensbury Local Board of Health hereby grants the variance to Byron Rist, applicant for Leon Davis, to allow a holding tank and that the holding tank be installed at the existing grade and then filled around and over on property situated on Assembly Point Road in the Town of Queensbury, New York, and bearing Tax Map No. 8-3-5. Duly adopted this 20th day of October, 1997, by the following vote: AYES : Mrs. Monahan, Mr. Turner, Mrs. Goedert, Mr. Champagne NOES : None ABSENT: Mrs. Pulver 2
