RESOLUTION SETTING PUBLIC HEARING
ON PROPOSED LOCAL LAW NO.: ____ OF 1998
TO AMEND CHAPTER 179 OF THE QUEENSBURY TOWN CODE
ENTITLED, “ZONING,” SECTION 179-7 THEREOF,
ENTITLED, “DEFINITIONS AND WORD USAGE” AND
SECTION 179-73.1 ENTITLED, “TELECOMMUNICATIONS TOWERS”

WHEREAS, at this meeting there has been presented for adoption by the Town Board of the
Town of Queensbury, proposed Local Law No.: ___ of 1998 to amend Chapter 179 of the Code of
the Town of Queensbury entitled "Zoning," to amend §179-7 thereof entitled, "Definitions and Word
Usage" to add two definitions concerning telecommunication towers and to amend §179-73.1 entitled,
“Telecommunication Towers," to include a new provision for Zoning Administrator approval for
shared use (co-location) of existing towers and outlining the administrative approval process, and
WHEREAS, such legislation is authorized pursuant to the §10 of the New York State
Municipal Home Rule Law and Article 16 of the New York State Town Law, and
WHEREAS, prior to adoption of said Local Law, it is necessary to conduct a public hearing,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury shall meet and hold a public

hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m. on August 17,
1998 to consider the proposed Local Law No.: __ of 1998, hear all interested persons and take such
action as is required or authorized by law, and
BE IT FURTHER,
RESOLVED AND ORDERED, that the Town Board of the Town of Queensbury hereby
authorizes and directs the Queensbury Town Clerk to publish and post the Notice of Public Hearing
presented at this meeting in the manner provided by law.
