BOH21.98 RESOLUTION DETERMINING THAT PROPERTY OWNED BY MATTHEW AND SHANNON CARPENTER (TAX MAP NO.: 47-4-5) IS A HEALTH HAZARD BOARD OF HEALTH RESOLUTION NO. : 21, 98 INTRODUCED BY: Mr. Pliney Tucker WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, David Hatin, Director of Building & Codes Enforcement for the Town of Queensbury, has advised the Local Board of Health for the Town of Queensbury that he has received complaints from neighbors concerning garbage and other debris on property owned by Matthew and Shannon Carpenter and located at 15 Country Colony Drive, Queensbury (Tax Map No.: 47-4-5), as more specifically set forth in a Queensbury Building and Codes Department Inspector’s Report dated th May 4, 1998, and WHEREAS, Dr. Robert L. Evans, the Town Health Officer, has investigated and inspected the property and has advised the Town that in his opinion the property is a health hazard and a nuisance to the neighborhood, with garbage and debris scattered throughout the property and easily accessible to children, the general public and animals, and is unsafe to the general public and therefore has strongly recommended that the property be cleaned up, NOW, THEREFORE, BE IT RESOLVED, that, upon reviewing all of the evidence presented at this time, the Town of Queensbury Local Board of Health is of the opinion that the property bearing Tax Map No.: 47-4-5 appears to be: 1.A potential object of attraction to rodents and animals; and 2.A nuisance, health hazard, unsafe and dangerous and therefore the garbage and debris should be removed and the property cleaned up; and BE IT FURTHER RESOLVED, that the Town of Queensbury Local Board of Health shall hold a hearing concerning the nuisance and/or unsafe condition of the property owned by Matthew and Shannon st Carpenter on June 1, 1998, at 7:00 p.m., in the Queensbury Activities Center, 742 Bay Road, Queensbury, Warren County, New York, and BE IT FURTHER RESOLVED, that the contents, service and filing of the Notice of Hearing shall be in accordance with the provisions of the New York Public Health Law.
