BOH60.98 RESOLUTION APPROVING SANITARY SEWAGE DISPOSAL VARIANCES FOR DAVID DUFRESNE BOARD OF HEALTH RESOLUTION NO.: 60, 98 INTRODUCED BY: Mr. Theodore Turner WHO MOVED ITS ADOPTION SECONDED BY: Mr. Richard Merrill WHEREAS, David Dufresne previously filed an application for three (3) variances from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, such application requesting that variances be granted to allow: 1.part of the infiltrator system to be located beneath the small parking area; 2.the absorption system to be located four feet (4’) from the property line rather than the required ten feet (10’) distance; 3.the septic tank to be located five feet (5’) from the dwelling rather than the required ten feet (10’) distance; and WHEREAS, a notice of public hearing was given in the official newspaper of the Town of st Queensbury and a public hearing was held in connection with the variance requests on December 21, 1998, and WHEREAS, the Town Clerk advises that property owners within 500 feet of the subject property have been duly notified, NOW, THEREFORE, BE IT RESOLVED, a) that due to the nature of the variances, it is felt that the variations will not be materially detrimental to the purposes and objectives of this Ordinance or to other adjoining properties or otherwise conflict with the purpose and objectives of any plan or policy of the Town of Queensbury; and b) that the Local Board of Health finds that the granting of the variances is necessary for the reasonable use of the land and that the variances granted are the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the applicant; and BE IT FURTHER, RESOLVED, that the Town of Queensbury Local Board of Health hereby grants the variances to David Dufresne to allow: 1.part of the infiltrator system to be located beneath the small parking area; 2.the absorption system to be located four feet (4’) from the property line rather than the required ten feet (10’) distance; 3.the septic tank to be located five feet (5’) from the dwelling rather than the required ten feet (10’) distance; on property situated on Brayton Road, North Queensbury and bearing Tax Map No.: 11-1-24. st Duly adopted this 21 day of December, 1998, by the following vote: AYES : Mr. Turner, Mr. Irish, Mr. Tucker, Mr. Merrill, Mr. Champagne NOES : None ABSENT: None
