RESOLUTION APPROVING SANITARY SEWAGE DISPOSAL
VARIANCES FOR RANDY RIVETTE

WHEREAS, Randy Rivette previously filed a request for four (4) variances from provisions of
the Town of Queensbury On-Site Sewage Disposal Ordinance, and
WHEREAS, a notice of public hearing was published in the official newspaper of the Town of

Queensbury and a public hearing was held in connection with the variance requests on August 17,
1998, and
WHEREAS, the Town Clerk advises that property owners within 500 feet of the subject
property have been duly notified,
NOW, THEREFORE, BE IT
RESOLVED,
a) that due to the nature of the variances, it is felt that the variations will not be materially
detrimental to the purposes and objectives of this Ordinance or to other adjoining
properties or otherwise conflict with the purpose and objectives of any plan or policy of
the Town of Queensbury; and
b) that the Local Board of Health finds that the granting of the variances is necessary for
the reasonable use of the land and that the variances granted are the minimum variances
which would alleviate the specific unnecessary hardship found by the Local Board of
Health to affect the applicant;
and
BE IT FURTHER,
RESOLVED, that the Town of Queensbury Local Board of Health hereby grants the variances
to Randy Rivette allowing:
eighty feet (80’)one-hundred
1.a leach field installed from the well in lieu of the required
feet (100’)
setback;
one foot (1’)ten
2.a leach field installed from the front property line in lieu of the required
feet (10’)
setback;
ten feet (10’)twenty feet
3.a leach field installed from the dwelling in lieu of the required
(20’)
setback (and leachfield will be close to the basement floor elevation); and
three feet (3’)ten feet
4.a septic tank installed from the foundation in lieu of the required
(10’)
setback (and the tank will be close to the basement floor elevation)
on property situated at 57 Sullivan Place, Queensbury and bearing Tax Map No.: 38-1-4.
