RESOLUTION TO ENACT LOCAL LAW REGULATING WATER METERS

WHEREAS, sealed water meters are located in homes and commercial enterprises throughout
the Town of Queensbury Consolidated Water District (the “Water District”) for the purpose of
measuring water usage, and
WHEREAS, having water meters in good repair and optimal working condition is essential in
order to properly determine water usage by Water District customers, properly charge customers for
water usage, prevent theft of water and ensure a safe water supply for the Water District, and
WHEREAS, the Town Board is concerned about public safety and wishes to ensure that all
water meters are in good repair and optimal working condition, and
WHEREAS, the Town Board is concerned about preventing theft of water and wants to make
sure that all water being taken by the public passes through a water meter, and
WHEREAS, there are a number of residences within the former West Glens Falls Water
District which currently have no water meters but are expected to have such meters within twelve (12)
months and so a temporary exception is allowed for those residences, and

WHEREAS, in accordance with Town Law 198(c) and Municipal Home Rule Law 10, the
Town Board may, after a public hearing upon at least ten (10) days public notice, enact an Local Law
regulating the operation of the Water District and the use of water therein, and
WHEREAS, after proper public notice, a public hearing on the proposed Local Law
Regulating Water Meters was held on June 21, 1999, and
WHEREAS, the Town Board wishes to enact the Local Law Regulating Water Meters,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Queensbury hereby enacts the proposed
Local Law Regulating Water Meters presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes and directs
the Queensbury Town Clerk to enter the Local Law Regulating Water Meters in the minutes of this
Town Board meeting and file it in the Office of the New York Secretary of State and the Local Law
Regulating Water Meters shall take effect upon such filing.
