This permit shall not be construed as conveying to the applicant ' any right to trespass upon the lands or interfere Stith the riparian rights of others in order to perform the permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held or vested in a person not a party to the permit. 6. Any modification of this permit granted by the Commission must be in writing and attached hereto. 7. That the State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 8. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services, New York State Department of Environmental Conservation, Adirondack Park Agency or local government which may be required. 9. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coatings, paint, concrete, leachate or any other environmentally deleterious materials associated with the project. 10. There shall be no unreasonable interference with navigation by the work herein authorized. 11. All scrap or unused construction materials shall be removed from the ice and/or waters of Lake George. 12. Disturbance to the bed and banks of Lake George shall be kept to the minimum necessary to complete the project. SPECIAL CONDITIONS 13. No commercial use, as defined in 6 NYCRR 645-2.1 (8) & (9) , of the permitted dock, wharf, or mooring, is authorized. 14. No part of the dock shall extend more than 40 feet from the mean low water mark and no part of the dock may extend more than 100 feet from the mean high water mark. 15. Every dock or wharf constructed shall have a minimum setback of twenty feet from the adjacent property line extended into the lake on the same axis as the property line runs onshore where it meets the lake, or at a right angle to the mean high water mark, whichever results in the greater setback. PERMIT NUMBER 2-5234-007-88 Page 2 of 6 ADDITIONAL SPECIAL CONDITIONS 16. No application for modification to the size, shape, or configur- ation of the wharf may be granted without a variance. 17. Cutting or clearing of vegetatian for wharf construction or access shall be limited to an area not to exceed five (5) feet running north to south along the frontage of the property. Vegetatian along the remainder of the property's frontage shall be left in its natural state. 18. Upon written request of the current permittee to the Park Commis- sion the Commission will issue a modification to the permit esta- blishing William Bernard, who has entered into a legal agreement to purchase the subject parcel , as the permittee. 19. The permittee has modified his original proposal , reducing the proposed overall width from 38 feet to 26 feet. Upon completion of construction, the permittee will provide to the Commission as built plans of the wharf showing all dimensions and property setbacks. ITEM OF FACT 1.
