Dear Mr. Finger:
This is to formally advise you that your building permit
application for the construction of a new U shaped crib
dock on the above property has been denied. The basis for
the denial is as follows:
Your property is located in an R-1 zoning district. The
permitted principal use in this district is a single family
detached dwelling.
For the purpose of the Queensbury Zoning a dock is considered
to be an accessory structure. Article 3 , section 3 .201
defines an accessory use or structure as a use or structure
subordinate to the principal use of a building on the same
lot, and serving a purpose customarily incidental to the use
of the principal building .
Therefore, in the absence of the principal use as described
above there can be no accessory structure constructed on a
parcel of property.
However, the new proposed Zoning Ordinance for the Town of
Queensbury has a provision for lake shore properties that
will allow the construction of a dock on vacant legal size
lots. We are anticipating the enactment of the new Ordinance
later this month or early June. I suggest that you resubmit
your application at that time.
