Post Star PLEDGE OF ALLEGIANCE LED BY COUNCILMAN POTENZA OPEN FORUM Lee York-Senior Planner for the Town of Queensbury, Good Evening. The Advisory Committee for the Queensbury land use plan has requested that the Town Board extend the building moratorium to allow them time to complete their job. To date the committee has completed a number of tasks within the Master Planning framework, including: Town Issue Identification; Slope Analysis; Historic Inventory; Population & Housing Analysis; Inventory of Existing Land Use; Natural Resources Inventory & Analysis; Soils Analysis; Community Facilities & Service Evaluation; Highway Analysis; Vista & Viewshed Identification. Maps that have been generated include, a Water Resources Map which includes Flood Prone Areas, Watershed boundaries and Aquifer Recharge Areas, also, we have done maps on Soils Percolation Rates, Soils Depth to Bedrock, Soils Analysis, Depth to High Water Table, Terrestrial & Aquatic Ecology, Slope Analysis, Viewshed Map, Historic & Archeological Site Map, Current Land Use & Zoning Maps, community Facilities Alap and an Intrinsic Suitability Map. The reports that have been generated and reviewed as part of this process include: Queensbury Growth Attitude Survey; Realtors Survey; Commercial Property Survey; Demographics & Housing Study; Traffic Study; Geologic History of the Glens Falls/Queensbury Area; Groundwater and its movement and Current Land Use Report. Environmental worksheets on the following natural resource areas have been prepared by the Environmental Sub Committee for the Land Use Plan, the topics were:Freshwater Wetlands; Streams & Rivers; Lakes, Ponds, & Reservoirs; Archeological Sites; Scenic Roads & Vistas; Terrestrial Ecology; Trail & Walkway System. At this juncture the committee is in the process of completing the subdivision regulations and a broad brush zoning map based on existing physical limitation, from here they will proceed to the very specific neighborhood zoning maps, at the same time, they will be working on the zonit ordinance itself and completion of the Land Use Plan. Their request to the Town Board 1s to extend the Moratorium to give them the time to complete these tasks and allow for public review and comment as well as to allow for appropriate time to prepare a documentation on the plan and regulations for the necessary state agencies. At this time I would like to introduce some of the members of the committee, Dorothy Burnahm, Peter Cartier, David Kenny, and Keith Jablonski. Does anyone have any questions that I can answer at this point in time? Supervisor Borgos-There is alot of information and its a very impressive list. The entire board has been staying out of your discussions, that is intentional, we don't want to have the political input. We will have our opportunity later to take a look at it. This perhaps will give everyone some idea of not only what you have been doing but why things are taking so long. I understand that you are approaching the 100 hour mark of actual meeting time, is that correct? Lee York-Yes it is, we are meeting twice a week instead of the usual once a week. Supervisor Borgos-Those members of the public who are not involved should realize the tremendous effort that is being put forth by these people, the future of our town is in your hands. Noted that we will have a resolution to talk about extending the Moratorium. Lee has given us the background for that. Is there anyone else who wishes to address the Board in open forum? Councilman Montesi-Stated that he had an opportunity to walk the properties at Highland Park, its a beautiful piece of land and not all wet, a fine acquisition for the Town of Queensbury r in terms of a passive recreational facility, with two parking lots, one on Haviland Road and one on Meadowbrook Road. Jointly the Town of Queensbury and DEC will be able to develop into a passive recreational area, nature walk or possibly at the most a cross country ski trail. Secondly our pump station for Queensbury Central Sewer District is now in place, this is a prefabricated pump station, some of the sections weighed up to 43 tons and are down in the ground 32 feet. Kestner Engineer was present along with Tom Flaherty. Hopefully we should. be on line within the next month. Supervisor Borgos-Request that Counsel Mathias brief us on the progress of our equalization rate. Counsel Mathias-appeared before a hearing officer designated by the State Board of Equalization and Assessment, which is a formal proceeding where-by towns, villages and cities in New York can protest the tentative Equalization Rate that the State sets for municipalities throughout the state. They said that our assessments were 164% of the true value of the properties of the town. Its important to note that they base that figure by comparing the 1987 assessments with their last survey for property within the Town of Queensbury which is July 1, 1983. Noted that out of 1400 or 1500 towns, cities in the state of New York there was only eight that chose to contest their Equalization Rate and only three of them decided to show at the hearing. The State of New York in providing aid to the Queensbury School District, does not treat it as rich a district as it appears right now, thereby allowing it to receive additional state aid. A very important factor if we are successful will result for all residents in the Town of Queensbury, we will pay a smaller percentage in the county tax. Our appraisers provided our own figures for assessments and the net result, the equalization rate we believe should be approximately 14% higher than what the state has it set. Therefore resulting in the tax savings to the residents in Queensbury particularly those that are in the Lake George School District. Our determination is that that rate should be in fact higher and the result of that is significant tax savings. Supervisor Borgos-Noted that the Town has recently advertised for the position of Assistant to the Assessor, Assistant Planner and laborers for Parks and Recreation. We are hoping to make some appointments within the next week or so. We will be advertising also for Town Attorney, Town Engineer, Legal Secretary, Sewer Inspector, Billing Clerk for Water Department and several others, all of which have been budgeted for. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka RESOLUTION ESTABLISHING LEAD AGENCY FOR TOWN OF QUEENSBURY LOCAL LAW PROVIDING FOR MORATORIUM RESOLUTION NO. 52, Introduced by Betty Monahan who moved for its adoption, seconded by Ronald Montesi: WHEREAS, Article 8 of the Environmental Conservation Law established the State Environmental Quality Review Act, and - WHEREAS, such act requires environmental review of certain actions directly undertaken by local governments, and WHEREAS, the Town Board of the n T of Queensbury wishes to consider the adoption of a local law providing for a stay of}A ays on the filing of applications for major subdivisions and site plan review in excess of four dwelling units, and WHEREAS, the anticipated impacts of such proposed local law are primarily of local significance, and YTHE EAS, Vie Town Board of the Town of Queensbury is duly qualified as lead agency with respect to the enactment of the above described local legislation, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury is hereby designated lead agency for purposes of SEQRA compliance in the adoption of a Master Plan and legislative amendments to the existing subdivision regulations and zoning ordinance, and be it FURTHER RESOLVED, that copies of this resolution be forwarded to the Commissioner of the Department of Environmental Conservation and the Region 5 Offices of the D.E.C., Department of Health, Department of Transportation, Warren County Planning Department, Lake George Park Commission, and the Adirondack Park Agency. Supervisor Borgos-stated that there is now a provision fora stay of 120 days approximately for an extension beyond the February 25th cut-off, we believe this the maximum extension. It is still to be determined whether or not we have to go through the full SEQRA process on this change. Alot will depend on what the documents look like, if there are major significant changes it is the opinion of counsel that we will have to go through the SEQRA process, which will require a period of at least 40 days beyond the time of filing the Draft Environmental Impact Statement. If it is the opinion of the Board after having looked at the document that it essentially is in compliance in conformity with what has been before with relatively slight modifications the Board may decide to issue a negative declaration, which will shortened the i period. Between the 4th of April and the 30th of April we will receive from the committee their final ideas of the Master Plan and Zoning and so forth,at which time the Board will have to make a determination. Prior to that time there will he public information sessions to get additional public comment and input, there will be a public hearing. States that he is concerned with the results of the delay on different elements of the community, businesses, property owners and developers, the overriding consideration is what effect it will have on the community. j i I RESOLUTION TO SET PUBLIC HEARING ON PROPOSED LOCAL LAW PROVIDING FOR MORATORIUM ON FILING OF APPLICATIONS FOR MAJOR SUBDIVISIONS AND SITE PLAN REVIEWS IN EXCESS OF FOUR DWELLING UNITS RESOLUTION NO. 53, Introduced by Betty Monahan who moved for its adoption, seconded by Marilyn Potenza: WHEREAS, the Town of Queensbury has experienced significant population growth and residential development during the 19801s, and such growth and development continue to occur at a rapid pace; WHEREAS, the Town of Queensbury wishes to preserve and protect the health, safety, and general welfare of its citizens, and such health, safety and welfare are threatened by a zoning ordinance and subdivision regulations which are not designed to handle the Town's present and future levels of growth and development; WHEREAS, the Town of Queensbury recognizes the need for orderly growth end development, and that such growth and development can only be fostered by adoption of a land use master `-- plan and new zoning and subdivision rules and regulations; WHEREAS, the Town of Queensbury has conducted or is conducting numerous hearings and studies of interest and necessity to the preparation and completion of a master plan and new zoning and subdivision rules and regulations; WHEREAS, the Town of Queensbury enacted Local Law No. 3 of 1987, a 180 day moratorium on major subdivision and site plan review applications, in order to provided the time needed for preparation and adoption of master plan and new zoning and subdivision rules and regulations; WHEREAS, the Town of Queensbury enacted Local Law No. 14 of 1987, a further stay of 120 days on major subdivision and site plan review applications, in order to provide additional time for preparation and adoption of a master plan and new zoning and subdivision rules and regulations; 1 l WHEREAS, the Town of Queensbury is in need of additional time to complete and enact said master plan and related zoning and subdivision rules and regulations, and such further stay is necessary to preserve and protect the health, safety, and general welfare of the citizens of the Town of Queensbury; NOW, THEREFORE, BE IT RESOLVED, that a public hearing be held on the annexed proposed local law which, if enacted, shall stay the filing of applications for major subdivisions and site plan reviews in excess of four dwelling units for an additional period of 126 days, and that said public hearing be held on February 23, 1988,at 7:30 P.M., in the meeting room of the Town Hall of the Town,of Queensbu Bay at Haviland Roads, Queensbury, New York, at which time all persons interested in the subject thereof shall be heard; IT IS FURTHER RESOLVED, that the Town Clerk of the Town of Queensbury be, and hereby is, directed to publish all such notice of said public hearing as is required by law. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka Local Law No. of 1988 Local Law to Stay Filing of Applications For Approval of Major Subdivisions and/or Site Plan Review in Excess of Four Dwelling Units i Section 1. Legislative Intent. This law is adopted in order to stay the application procedure for major subdivisions and site plan reviews in excess of four units under the Zoning Ordinance of the Town of Queensbury, New York, enacted May 25, 1982, as amended from time to time, and the Subdivision Regulations of the Town of Queensbury, enacted July 13, 1982, as amended from time to time, and sections 274-a and 276 of the New York Town law, as amended. The moratorium, which voids all unlawfully filed applications and disables all persons from filing or causing to be filed such applications, is of temporary duration. The i legislation is enacted in order to continue the stays of Local Law No. 3 of 1987, adopted April 29,1987, and Local Law No. 1.4 of 1987, adopted October 2.3, 1987. The additional moratorium period is needed in order to preserve and protect the health, safety, and general welfare of the citizens of the Town of Queensbury by allowing the town such additional time as is needed to prepare, complete, secure approvals, hold public hearings on, and enact such land use master plan and zoning and subdivision rules and regulations as are needed to provide for the orderly growth and development of the Town. I Section 2. Authority. This local law is enacted pursuant to Section 10 of the Municipal Home Rule Law of the State of New York. Section 3. Prohibitions. No person shall file or cause to be filed, within 126 days after the effective date hereof, an application or applications for approval for major subdivisions or site plan review in excess of four dwelling units. Any such application filed in violation of this section shall be void. No approval by operation of law shall result by the filing of an application in violation of this section. This provision shall not be waived. Section 4. Exceptions. This local law shall not apply to or affect applications for approval for Planned Unit Development, major subdivision, or site plan review in excess of four dwelling units where such completed applications have been filed with the appropriate Town Official prior to April 28,1987. _ i Section 5. Effective Date. This local law shall take effect on February 25,1988. Supervisor Borgos-Noted that there was a difference between resolutions on the period of days, asked whether it should be 120 days or 126 days? RESOLUTION TO ACCEPT TRUCK RESOLUTION NO. 65, Introduced by Ronald Montesi who moved for its adoption, seconded by Marilyn Potenza: RESOLVED, that the Town Board of the Town of Queensbury hereby accepts the donation _ "RU-108" pump truck from the Queensbury Volunteer Fire Company, to be used in Buildings & Grounds. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka Supervisor Borgos-Noting that the Town would use it in a fashion similiar to Saratoga... their flower power truck....that waters their flower gardens and will take care of the recreational areas. They are offering to give it to us and I would request that the board vote to accept the truck. My thought would be to give it to Building & Grounds and then shared as needed within the town. It is very nice to be on the receiving end, it is a very generous offer.
