Resolutions 1. Recommendation Project Description Applicant proposes a site plan modification to place a 280 sq. ft. generator shed at rear of property, relocating the 10’ x 10’ shed to one parking space. The site has an existing 4,929 sq. ft. building and a 2,560 sq. ft. fuel canopy – no changes are proposed. Pursuant to Chapter 179-9-120 of the Zoning Ordinance, modification of an Variance: approved site plan shall be subject to Planning Board review and approval. Relief is sought for dimensional requirements. Planning Board shall provide a recommendation to the Zoning Board of Appeals. Staff Comments  Location-The project site is located at 1002 State Route 9 on a parcel that is 1.459 acres.  Arrangement- The project site contains an existing 4,929 sq ft building for two tenants and a fuel canopy of 2,560 sq ft.  Site Design-The generator shed is to be 280 sq ft and located in the north east corner of the parcel.  Building – The existing building of 4,929 sq ft is to remain with no changes. The Stewart’s Shop is a 2,968 sq ft space with a 450 sq ft entry canopy and the vacant tenant is 1,961 sq ft with a drive thru area.  Site conditions-  Traffic- The site has 31 parking spaces where 30 spaces are required, with some parking for accounted within the fuel pumps. There is an existing shed of 100 sq ft that is to be relocated to one of the parking areas adjacent to the dumpster area. The site will then have 30 parking spaces.  Grading and drainage plan, Sediment and erosion control-There are no changes to the existing stormwater management on the site.  Landscape plan-The existing landscaping is to remain.  Site lighting plan-There are no changes to the lighting on the site or building. There are no new lights for the generator shed.  Utility details-There are no changes to the site utilities.  Elevations and Floor plans -The shed is to face State Route 9 and is an open shed to allow for the storage of the generator unit.   Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.  The waivers requested–Staff finds it reasonable to request a waiver as the project is specific to a generator shed and the reduction of one parking space for a shed relocation then no other site conditions or buildings are being changed  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Nature of Variance The new generator shed is to be located 10 from the rear property line where a 25 ft setback is required.
