TOWN BOARD MEMBERS Mr. Stephen Borgos-Supervisor Mr. George Kurosaka-Councilman Mrs. Marilyn Potenza-Councilman Mr. Ronald Montesi-Councilman Mrs. Betty Monahan-Councilman Pledge of Allegiance led by Darleen M. Dougher, Town Clerk (Note Mrs. Potenza was not present before vote on Resolution No. 209) — Supervisor Borgos-I am requesting an executive session to continue the discussion on engineering proposals that have been made to us we are anxious to select a firm we also wish to discuss pending litigation and two personnel matters. RESOLUTION CALLING FOR EXECUTIVE SESSION RESOLUTION NO. 209, Introduced by Mrs. Marilyn Potenza who moved for its adoption, seconded by Mr. George Kurosaka: RESOLVED, that the Town Board hereby moves into executive session to discuss the selection of an engineering firm, an issue of pending litigation and two personnel matters. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mrs. Potenza (Mrs. Potenza entered meeting) RESOLUTION TO RECONVENE RESOLUTION NO. 210, Introduced by Mrs. Marilyn Potenza who moved for its adoption, seconded by Mr. George Kurosaka: RESOLVED, that the Town Board hereby moves into Regular Session. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: None RESOLUTION TO RETAIN ENGINEERING FIRM RESOLUTION NO. 211, Introduced by Mrs. Marilyn Potenza who moved for its adoption, seconded by Mr. Ronald Montesi: WHEREAS, the Town Board of the Town of Queensbury has been interviewing various Engineering Firms to act on behalf of the Town of Queensbury as its engineering firm, and WHEREAS, the Town Board has reviewed all proposals that have come before them and have selected the firm of Kestner Engineers P.C. of Troy, New York to be the Town's Engineers, NOW, THEREFORE BE IT RESOLVED, that Kestner Engineers P.C. of Troy, New York will be retained as the Town Engineers, commencing on May 23rd. 1988 through December 31, 1988. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: None Supervisor Borgos-This is in response to proposal that had gone out earlier, the Board had decided not to hire a single individual as Town Engineer and this firm would preform the functions that, that engineer would have performed. The firm of Kestner Engineers are aware that from time to time we may decide to hire other engineers for special projects. We will be notifying the various Boards of this decision. DISCUSSION HELD MR. BURT MARTIN-CODE ENFORCEMENT OFFICER-TOWN OF QUEENSBURY-In relation to the Bavarian Palace of Mr. Woods-I was concerned with the Certificate of Occupancy being issued before they opened. We have researched our facilities and found that we had no record of a building permit being issued for this purpose. We went to Mr. Wood's Office and he had no record of it being secured. COUNCILMAN MONTESI- Was he surprised? MR. BURT MARTIN-Yes. He called the engineer thinking that maybe he might have the building permit and he had no record of it. We had Mr. Wood fill out an application, the building was up, I know the plans had been approved, because Mr. Harding and Mr. Dean of our Department had several conferences over these plans. I approved the permit and Mr. Wood paid the necessary fees to cover the permit and the certificate of occupancy. Mr. Bodenweiser was with me and looked over the building as far as the Building Dept. goes the building is pretty well finished. It is safe, it has correct railings on the outside the steps have railings the porches and ramps are all in. Mr. Bodenweiser found a few things that were wrong and we made a date tomorrow afternoon at 4:00 P.M. to meet with Mr. Wood and Jack Balfour and he has assured us that all the things that we have called to his attention will be concluded by that time. I have a temporary certificate of occupancy here which I will bring with me and if these things are handled correctly I will issue the certificate of occupancy. SUPERVISOR BORGOS- I understand that you are duly authorized to do this. MR. BURT MARTIN-Yes. SUPERVISOR BORGOS-Mr. Bodenweiser, do you have anything to add to what Mr. Martin has said? FIRE MARSHAL BODENWEISER-TOWN OF QUEENSBURY-I really have no further comment on the recommendation of the Code Enforcement Officer Mr. Martin, we have covered everything that we need to do to cover the law properly. If they do everything they are supposed to do by 4:00 P.M. tomorrow I would OK the issuance of the C/O. SUPERVISOR BORGOS-I am glad that we have resolved this, our research has indicated that there were no site plan reviews required and everything has fit in, we are happy to have this squared away. COUNCILMAN MONTESI-If this had gotten by us, Mr. LaRose would have never picked this up on the assessment roles because there was no building permit. On motion the meeting was adjourned.
