NEW YORK 12845 818-668-8476 September 20, 1978 John Mason Cleverdale, N.Y. 12820 Re: Arnstein Dear John, From the information gathered during my site -• inspection September 15, 1978 and our discussions at that time. The situation you have inquired about is as follows: 1. The Arnstein parcel is situated on a small point on the west side of Cleverdale in the Town *of Queensbury. 2. The lot is located in a Moderate Intensity Land Use Area. 3 . An existing single family dwelling is situated on the lot so that it is 13 ' 6" from the mean high water mark of Lake George, which is marked by a seawall, on the south side of the point and 28 ' 6" from the mean high water mark on the westerly side of the point, also delineated by a seawall. 4 . There are no wetlands on the site. 5. The Arnstein' s propose to remove this single family dwelling and replace it with a new single family dwelling at the same location. Please be advised that construction of the new single family dwelling will not require an Agency permit or variance so long as it is setback atleast 28 . 6 feet from the mean high water mark along the westerly shoreline and 13 . 6 feet from the mean high water mark along the southerly shore and so long as any new onsite sewage disposal system is atleast 100 ' from the mean high water mark of Lake George. This is of course provided the new structure is less than 40 ' in height and continues to be used as a single family dwelling. Letter to Mr. Mason page two September 19 , 1978 This determination is grounded on the fact that Section 811 of the Adirondack Park Agency Act provides that a single family dwelling may be rebuilt, replaced, expanded or enlarged so long as such activity does not violate or further ary existing noncompliance with, the minimum building setback of the shoreline restrictions . I should point out to you that this letter is based on the information supplied by you and recited herein. Should the facts differ from those recited, our nonjurisdictional determination could vary accordingly. Furthermore, this letter cannot serve to exempt your proposal from approval or permit requirements of other state or local governmental bodies.
