Hagan Box 303 Cleverdale, New York 12820 Dear Mr. Hagan: In a jurisdictional inquiry form accompanied by a site sketch, submitted to the Lake George office on March 22, 1979 you stated the following: 1. That you own approximately 21 acres of land located west of the Cleverdale Road, and north of Gunn Lane, in the town of Queensbury, Warren County, New York, the location of which is outlined on a map submitted by you. 2. That you purchased the subject property in August of 1977 from Allen McIntyre in its entirety, that is Mr. McIntyre did not retain any land adjacent or contiguous to the subject property. 3. That there is presently situate on the subject property a single family dwelling and a two-car carport, circa 1933 - 1940. 4 . That the existing single family dwelling is located approximately 230 ' from the shoreline of Lake George. 5. That you propose to expand the single family dwelling by adding a 21 ' x 15 ' addition to the existing single family dwelling. 6 . That the expansion will not bring the existing single family dwelling closer to the mean high water mark of Lake George. Based on the above information, I can state that the property involved in your proposal is located in a moderate intensity area as delineated on the Official Adirondack Park Land Use and Develop- ment Plan Map and does not involve a "critical environmental area" as defined by Section 810 (1) (b) (1) of the Adirondack Park Agency Act, and that expansion of the single family dwelling as described above is not subject to the review jurisdiction of the Adirondack Park s Agency and will not require a permit or approval from this Agency provided that any new on-site sewage disposal system is located at least 100 feet from the mean high-water mark of any lake, pond, river or permanent or intermittent stream and provided that any proposed structure is not in excess of forty feet in height. Furthermore, with respect to the shoreline of any lake or pond or navigable river or stream, any proposed structure exceed- ing 100 square feet in size (except docks and bcathouses) must be set back at least 50 feet from the mean high-water mark, and the following shoreline vegetative cutting restrictions apply: (a) Within thirty-five feet of the mean high-water mark not more than thirty percent of the trees in excess of six inches diameter at breast height existing at any time may be cut over any ten-year period. (b) Within six feet of the mean high-water nark no vegeta- tion may be removed, except that up to E, - aximun of thirty percent of the shorefront may be clear of vege- tation on any individual lot. This provision shall be adhered to in addition to (a) above. (c) The above cutting standards shall not be deemed to prevent the removal of diseased vegetation or of rotten or damaged trees or of other vegetation that present safety or health hazards. This non-jurisdictional determination is grounded on the fact that a single family dwelling or mobile home may always be enlarged or rebuilt to any extent provided that it continues to be used as such, provided, however, that no such increase or expansion shall violate, or increase any non-compliance with, the minimum setback requirements of the shoreline restrictions. I should point out to you that this letter is based on infor- mation supplied by you and recited herein. Should the facts differ from those recited, our non-jurisdictional determination could vary accordingly. Furthermore, this letter cannot serve to exempt your proposal from approval or permit requirements of other state or local governmental bodies.
