The new and remaining buildings at the Mooring Post will be a total of 38,300 square feet. The new construction will result with 55.55 less square feet, as the former buildings totaled 38,355.55 square feet. Please note that both calculations excluded buildings 8,9,12,14 and 15. The marina has had the capabilities storing approximately 200 boats and quick launching between 140 and 160 boats. After the completion of the renovations the marina will have the same capabilities for both storage and quick launch. With the beginning of the 1995 boating season the marina will no longer offer public launching. The lack of this service will mean fewer cars and boat trailers parked on the site while customers are using the lake for day or overnight use. We ask that you reply to several questions so that we can determine whether the Commission has jurisdiction over this project. For any modifications to facilities governed by the Commission's regulations, it is generally recommended that a jurisdictional determination be requested before a project is undertaken. I enclose a copy of the 1982 Department of Conservation Marina Permit. I also enclose a copy of the Park Commission's regulations adopted in 1988 governing Class A Marinas. I'd like to bring your attention to two issues which need to be addressed in our review of the reconfiguration project. 1. Marina Expansion Commission regulations require that a permit modification be obtained prior to the expansion of services or vessels serviced as follows: "No person shall construct, expand, or operate a Class A marina servicing the waters of Lake George, or alter or expand the number or type of services or recreational activities offered without obtaining a permit from the commission, or if a permit has been issued for the subject facility, a modification to the permit for that facility which authorizes the new or expanded services or recreational uses." "Any change in use of an existing marina which increases the number and/or types of vessels serviced shall require a modification to any previously issued permit." In order to determine if the current reconfiguration project involves an expansion the following must be answered: How were the boat storage facilities used in 1982, 1988 and at the time of application to the Town of Queensbury for a building permit for the new facilities? October 20, 1994 t fohn Brock page 2 of 2 In answering this question, please note the distinction drawn by the regulations between "quick launch" facilities and winter storage facilities. The regulations define a quick launch as: "a facility or an activity whereby vessels are stored on land and periodically launched for use during a single boating season. The periodic storage, launching and storage of a vessel by the same person at the same location shall be presumed to be a quick launch facility; provided,however, that the storage of a vessel on residential property for use by the owners or lessees of that property shall not be a quick launch facility regardless of the number of times the vessel is launched and stored during a single boating season." Quick launch facilities are subject to annual regulatory fees based on the amount of useable linear footage of dry storage capacity. The 1982 permit does not reference quick launch facilities and no regulatory fees have been received for any quick launch facilities at this site. Please indicate the number of quick launch vessels stored and launched at the facility during the 1982, 1988 and 1994 seasons. Also indicate if records are available to support these figures. I enclose a Marina application form for your use if you determine that a modification to the 1982 permit is required. 2. Required Parking The 1982 Marina permit required parking for 50 customer vehicles be provided. Commission regulations require that marinas provide: "One on-site parking space or adequate off-site parking for each vessel berthed. Where the Class A marina offers rides, instruction or water-based recreation for a fee, adequate parking must be provided for customers of the Class A marina." Your reconfiguration plans should include parking for each of the berthing slips accomodated and each quick launch space as required by current regulations. Please forward a copy of the plans showing adequate parking. Due to the fact that construction is underway we are requesting that as much of the above information as possible be delivered in writing to the Lake George Park Commission office by the close of business (4:30 PM) Friday, October 21, 1994.
