3.13 ,t 3.13 AGREEMENTS\Glens Falls Animal Hospital— 12-21-2020 RESOLUTION AUTHORIZING AGREEMENT BETWEEN TOWN OF QUEENSBURY AND GLENS FALLS ANIMAL HOSPITAL RESOLUTION NO. ,2020 INTRODUCED BY: WHO MOVED FOR ITS ADOPTION SECONDED BY: WHEREAS, the Town of Queensbury wishes to enter into an Agreement with the Glens Falls Animal Hospital (Animal Hospital) for the Animal Hospital's care of dogs found within the Town by the Society for the Prevention of Cruelty to Animals of Upstate New York, Inc. (SPCA), Warren County Sheriff or New York State Police which are in need of veterinary care during normal business hours if capacity allows, including euthanasia where appropriate,and WHEREAS, a proposed Agreement for 2021 has been presented at this meeting and is in a form acceptable to the Town Clerk and Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes the Agreement between the Town and Glens Falls Animal Hospital providing for the Glens Falls Animal Hospital's provision of veterinary care during normal business hours if capacity allows, including euthanasia where appropriate, effective January 1, 2021, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute such Agreement substantially in the form presented at this meeting on behalf of the Town of Queensbury, and the Town Board further authorizes and directs the Town Supervisor, Town Clerk, Town Budget Officer and/or Town Counsel to take such other and further action as may be necessary to effectuate the terms of this Resolution. Duly adopted this 21 S`day of December,2020,by the following vote: AYES NOES ABSENT: t AGREEMENTS\Glens Falls Animal Hospital—2021 AGREEMENT BETWEEN TOWN OF QUEENSBURY AND GLENS FALLS ANIMAL HOSPITAL This AGREEMENT made as of the I'day of January, 2021 (Effective Date)by and between the TOWN OF QUEENSBURY, a municipal corporation organized and existing under the laws of the State of New York and having a principal place of business at 742 Bay Road, Queensbury, New York (hereinafter referred to as the "Town") and the GLENS FALLS ANIMAL HOSPITAL, a Corporation organized and existing under the laws of the State of New York and having a principal place of business at 66 Glenwood Avenue, Queensbury,New York (hereinafter referred to as the"Animal Hospital"); WI TNESSE TH: WHEREAS, in accordance with New York State Agriculture and Markets Law Article 7 and Queensbury Town Code Chapter 73, the Town of Queensbury is authorized to seize dogs within the Town of Queensbury that, among other things, run at large and/or cause physical harm to persons and damage to property, and WHEREAS, from time-to-time the Town is in possession of dogs that require veterinary attention;and WHEREAS, the Animal Hospital has offered to provide such services during regular business hours if capacity allows, including euthanasia where appropriate, and WHEREAS, the Animal Hospital has also agreed to accept from the Town animal carcasses for destruction, NOW, THEREFORE, for good and valuable consideration as set forth herein, the parties agree as follows: 1. The Animal Hospital agrees to accept and provide veterinary services to dogs in the possession of the Town of Queensbury or its representative, provided that the Animal Hospital has capacity and provided that such services are needed during the Animal Hospital's regular business hours. 2. The Town shall pay the Animal Hospital's fee for this care, but such a fee shall not be in excess of$400.00 for the care provided to any one dog. 3. In the event the Animal Hospital keeps any dog it is treating overnight, it will be compensated by the Town in the amount for boarding in accordance with Schedule A. 4. The Animal Hospital will, where warranted, euthanize dogs and will cremate all such dogs. 5. The Animal Hospital will also accept and cremate animal carcasses delivered to it by the Town. For all such services,the Town will be charged in accordance with Exhibit A. 6. It is understood by the parties that veterinary care provided under this Agreement applies only to dogs that were seized within the Town of Queensbury by either the Town (or SPCA on behalf of the Town), the Warren County Sheriffs Department or the New York State Police. Nothing in this Agreement shall make the Town responsible for expenses related to euthanasia and cremation of animals brought to the Animal Hospital from other municipalities and/or individuals. 7. The Animal Hospital shall bill the Town monthly for the services provided under this Agreement. 2 0 8. This Agreement shall be effective from January 1, 2021 through December 31, 2021 and shall be renewed annually thereafter unless either party shall notify the other party of a desire not to renew.
