Box 866 Glens Falls , N.Y. 12801 Dear Mr. O'Connor: In a letter accompanied by a survey map and a deed all received here at the Adirondack Park Agency on July 26 , 1979 and in a letter accompanied by a location map received here at the agency on August 21, 1979 , you stated the following : 1) That Ernest A. Kirchoff owns approximately 20+ acres of land located on the eastern side of the Cloverdale Road in the Town of Queensbury, Warren County , New York. The location of which is pin pointed on a map submitted by you. 2) That Ernest A. Kirchoff proposes to create a 2 . 78 acre parcel from the subject 20+_ acres of land he presently owns . 3) That this 2.78 acre parcel is presently vacant. 4) That the proposed buyer will construct a single family dwelling on the subject property. An Agency wetlands expert has indicated that there are no "wetlands" situate on the property, that is , any land which is annually subject to periodic or continual inundation by water and commonly referred to as a bog, swamp or marsh. Based on the above information, I can state that the pro- perty involved in your proposal is located in a moderate intensity use area as delineated on the Official Adirondack Park Land Use and Development Plan Map and does not involve a "critical environmental area" as defined by Section 810 (1) (b) (1) of the Adirondack Park Agency Act, and that the project as outlined above is not subject to the review jurisdiction of the cter co %L . v l u,,,,v,_ �_,y i..wv j_ 4 k. ,2, i 5 Adirondack Park Agency and will not require a permit or ap- proval from this Agency provided that any new on-site sewage disposal system is located at least 100 feet from the mean high water mark of any permanent or intermittent stream; and provided that any proposed structure is not in excess of 40 feet in height. This determination is grounded on the fact that the sub- division of land in a moderate intensity use area, not involving shoreline where less than 15 lots , parcels or sites are to be created or retained and where each lot parcel or site to be created or retained is at least 40 , 000 square feet in size is not a Class A or Class B Regional Project subject to Agency review. I should point out to you that this letter is based on information supplied by you and recited herein. Should the facts differ from those recited, our nonjurisdictional deter- mination could vary accordingly. Furthermore, this letter cannot serve to exempt your proposal from approval or permit requirements of other state or local governmental bodies.
