Discussion: Zoning Code Review Have finished the Subdivision Review and are working on finishing the sign ordinance which will be sent to the APA. Zoning Administrator Craig Brown-Lead the Town Board through the proposed changes in the Zoning Ordinance. ? Article I - no changes ? Article II - Definitions 1. ACCESSORY STRUCTURE – add six feet in width or more 2. APARTMENT HOUSE – Add A building arranged in single dwelling units and intended or designed to be occupied by three or more families living independently of each other, which building may or may not have common services and entrances and which units are rented 3. AUTO BODY/REPAIR SHOP – Add Any building, premises and/or land in which or upon which the primary use is a business which involves the service, maintenance or repair of automobiles, and other small vehicles under 2 ½ tons and motors, including the repair of the body or frame of an automobile, including painting, straightening, sanding and welding, within an enclosed structure and in which the sale of materials is clearly incidental to the primary use. 4. BED AND BREAKFAST – Change from ten to six or fewer guest rooms 5. CONSTRUCTION COMPANY – Add Businesses related to the construction trade, including but not limited to paving companies, bricklayers, septic tank cleaning companies, well drillers, installation and building companies and similar businesses where machinery, equipment, supplies and materials are stored and maintained for use or installation at another location. 6. ELECTRIC POWER PLANT – Add A facility where electric power is produced for transmission across the power grid. Councilman Montesi-Questioned if there is anything in the law regarding wind turbines? Administrator Brown-Would we allow them, yes, do we regulate them, they would have to comply with height regulations. Will research this issue. 9. FLOOR AREA RATIO – Leave as is. 10. KENNEL – Leave as is. 11. MUNICIPAL CENTER – Need definition 12. NO CUT ZONE – Add A no disturbance zone to be vegetated area of where no vegetation is removed and no disturbance of land takes place. This area may not be used for vehicular storage, accessory structures, open storage, driveways, athletic courts, and stormwater or wastewater system. Councilman Metivier-Change to NO DISTURBANCE ZONE Councilman Strough-Change to reflect a No Cut Zone is a No Disturbance Zone 13. PRIVATE SCHOOL- Add definition Discussion held on Helicopter tour business-suggestion that it should be held at the Airport… 14. RECYCLING CENTER – A place where recyclables are collected, sorted, baled and/or packaged in preparation for processing at a recycling plant. Will double check to see if more wording is necessary. 15. REPOSESSION FACILITY – An establishment primarily engaged in the recovery and short term storage of repossessed items. This type of facility may include an office and either indoor and/or outdoor storage areas. ? ARTICLE 3 – Zoning Districts 1. Need to add residential use table, numbering of the tables will be changed. 2. (3) Moderate-density residential (MDR) Discussion on setbacks, not ok for State Avenues and Ogden and Pinello area, Meadow Lane, Meadow Drive, Glenwood, Fort Amherst etc. …lots small sized would need variances for development. Could be change to Neighborhood Residential…the uses do not change just the setback requirements. Board agreed to change States Streets to NR 3. (4)[3] Side yard setback add if connected 4. (4) (b) [8] Water frontage change to 75’ 5. B. Commercial Districts [1] Density [a] requested to be reviewed again… 6. (B) [10] Maximum building size [a] change to read 75,000 square feet footprint with a 150,000 total square footage for properties within the Bay Road Design Guideline areas and 20,000 square feet total all those properties outside the Bay Road Design Guideline area. 9. The applicable standards and requirements set forth in all other Articles of this chapter shall apply to all uses in this district as well as expansion, remodeling or change of use to existing structures and uses. In addition, large-scale uses shall submit and have approved a long-term plan (15 years or more) as part of the site plan submittal that defines all uses, intensities of uses, entertainment and/or recreational activities and any other features of the use that are deemed relevant by the Planning Board. 19. (5) (b) [3] Side yard setback; zero if buildings are connected others 20 feet. 20. (5)(b) [4] Rear yard setback: 10 feet remove rest of verbiage 21. (5)(b) [9] Building height: 50 feet. Remove four stories and Supervisor Stec-Building and Codes staff will be empowered to enforce the Code but Craig will be the official arbitrator of appeals. 22. (5) (c) Development standards. The applicable standards and requirements set forth in all other Articles of this chapter shall apply to all uses in this district as well as expansion, remodeling or change of use to existing structures and uses. In addition large-scale uses shall submit and have approved a long-term plan (15 years or more) as part of the site plan submittal that defines all uses, intensities of uses, entertainment and/or recreational activities and any other features of the use that are deemed relevant by the Planning Board. 23. (6) (b) Dimensional requirements –add of Table 1 of this Chapter and as follows 24. (6) (b) [1] change to 2000 square feet of principal building per 15,000 square feet of land. In addition, large-scale uses shall submit and have approved a long-term plan (15 years or more) as part of the site plan submittal that defines all uses, intensities or uses, entertainment and/or recreational activities and any other features of the use that are deemed relevant by the Planning Board. Further, for all retail uses (including but not limited to business, personal and food service uses) the building footprint and/or area of use must be wholly located within 500 feet of the frontage road. 28. (7) (2)(c) Development standards. The applicable standards and requirements set forth in all other Articles of this chapter shall apply to all uses in this district as well as expansion, remodeling or change of use to existing structures and uses. In addition, large-scale uses shall submit and have approved a long-term plan (15 years or more) as part of the site plan submittal that defines all uses, intensities of uses, entertainment and/or recreational activities and any other features of the use that are deemed relevant by the Planning Board. Remove the other (c) 29. (7) (3) Veterans Field-need to speak to Town Counsel on this. Supervisor Stec-We will revisit this again in June. Councilman Strough-Need to take a look at the old sign regulations on Main Street and we need to discuss canopies. Need to meet on Main Street regarding signage, design standards, setbacks, density requirements making sure everything jives.
