Resolutions 1. Recommendation Project Description Applicant proposes a modification to an approved plan to not install a proposed water feature of 3,230 sq. ft. and instead to install a pool and patio area of 1,405 sq. ft. There are no changes to the house and garage (4,915 sq. ft.), porte-cochere (360 sq. ft.), bunkhouse (500 sq. ft.), patio, sport court and other associated sitework (8,860 sq. ft.). Pursuant to Chapter 179- 9-120 of the Zoning Ordinance, modifications to an approved site plan Variance: shall be subject to Planning Board review and approval. Relief is sought for pool location. Planning Board shall provide a recommendation to the Zoning Board of Appeals. Staff Comments  Location-The project site is located at 12 Shore Acres Road on a parcel of 2.71 ac.  Arrangement- The project site is currently under construction with a single family home and associated site work.  Site Design- The project modification is to construct 20 ft x 50 ft pool instead of a water feature. The project includes a spa and patio area adjacent to the pool area. The previous plans also had a spa patio area as part of the water feature the new location is closer to the home.  Building – There are no changes to the proposed buildings on the site.  Site conditions-The site is currently under construction.  Grading and drainage plan, Sediment and erosion control-The applicant has provide an updated stormwater management that has been referred to the engineer for review and comment.  Landscape plan-the plans have been updated to show landscaping in the area of the water feature. The previous plan had included lawn area where the pool is proposed. The area now includes lawn and the pool.  Utility details-The plans note to install the pool the septic is to be relocated to the south side of the proposed home/pool area.  Elevations-The applicant has included the previously approved elevations plans for the site.  Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.  The waivers requested–Staff finds it reasonable to request a waiver as these items are typically associated with commercial projects.  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Nature of Variance The pool is to be located on the shore side of the property where the code refers to this area as a front where pools are not allowed, relief is requested for the pool location.
