2010-07-12 SP MTG.#26 SPECIAL TOWN BOARD MEETING 07-12-2010 MTG. #26 959 SPECIAL TOWN BOARD MEETING MTG. #26 July 12, 2010 RES. 256 7:50 p.m. TOWN BOARD MEMBERS PRESENT SUPERVISOR DANIEL STEC COUNCILMAN ANTHONY METIVIER COUNCILMAN RONALD MONTESI COUNCILMAN JOHN STROUGH COUNCILMAN TIM BREWER TOWN OFFICIALS CRAIG BROWN, ZONING ADMINISTRATOR STU BAKER, SENIOR PLANNER SUPERVISOR STEC-Opened the Meeting. DISCUSSION: ZONING CODE REVIEW ARTICLE 4 GENERAL REGULATIONS CRAIG BROWN- Need language from old 179-4-010 regarding use regulations. This section includes the definitions of the table abbreviations… PU, SPR, SPU, etc. Also need to add language back in that limits one home per parcel. For some reason this was left out when it went to press this time. SECTION 179-4-010 Typo in section G 4 (c) 6 where it ways “ordinance high water mark” should be changed to “shoreline” SUPERVISOR STEC- John Savre represents Joe DeSantis, owner of Carl R’s Café, and is here tonight to speak regarding the prohibition of the drive thrus in the Main Street Corridor. John Savre- The issue we presented in our letters on the Main Street Zoning District is that we believe that there is an expectation for travelers off the Northway that there is going to be drive thru windows. Seems like any major highway throughout the country you get off you want something quick to eat. We think that that’s natural inclusion in the new zoning district. We also feel that it’s in keeping with the current spirit of exit 18. SUPERVISOR STEC- We are very receptive to making a change that would accommodate this concern. We haven’t come up with specific language but we know what the request is. 179-4-080 Setbacks and Porches, Canopies and Decks Revised to remove “front yard” 179-4-090 Parking and Loading Regulations In the 2009 zoning code, the size of the parking spaces jumped up from 18 to 20, which is making parking lots bigger. Reduce that back to 18 to be consistent with 2002 code. REFER TO PARKING TABLE In the current code there is not a parking standard for every use so this was revised to offer standards for all uses listed in the code. The plan is to update it anytime we add a use. Before that table starts in item 6 we put back in the Planning Board can allow for the construction of fewer spaces. You still have to show that you can get them on your lot. SPECIAL TOWN BOARD MEETING 07-12-2010 MTG. #26 960 ARTICLE 5 SUPPLEMENTARY REGULATIONS 179-5-010 Intent Eliminate the description and leave it blank (do not renumber this section). 179-5-040 Agricultural Uses Agricultural uses in paragraph A prohibits AG in MDR but table shows as a SPR use. Remove from table. Code should prohibit in MS and O as well. 179-5-060 Docks, Boathouses and Moorings Add separation distance for docks on the same property. 179-5-070 Fences See C. Residential Zones (4) Revise to add clarification- you can have a privacy fence in your front yard up to the thirty foot front setback but it’s got to stay in the property line. E. Shorelines (2) Revise to state: no fence greater than 200 square feet in area, measured by the vertical surface area of one side as circumscribed by its perimeter, shall be located within the shoreline setback. 179-5-130 Telecommunication Towers (including cell towers and antennas) Remove all the LI references and replace with CLI 179-5-140 Tourist Accommodations Move this information to Article 10 SUP. ARTICLE 6 ENVIRONMENTAL AND PERFORMANCE STANDARDS 179-6-010 Extensive Clearing of Vegetation and Grading B. Revise from one quarter acre to one acre. This is consistent with the DEC regulations. 179-6-050 Shoreline Regulations D 4 Shoreline fill or hard surfacing- revise and add 15 feet in width with a total width of filling not to exceed 40 feet. This allows for 4 feet of fill to be placed at a 3/1 slope on either side of the drive. OTHER DISCUSSIONS HELD COUNCILMAN STROUGH- Questioned an email he sent to the rest of the Board Members regarding office signage. Do we want to put something in the code under signage or under office? SENIOR PLANNER, STUART BAKER- It makes more sense to put it with the signage code. We can put something in the office section in Article 7 to the signage code. COUNCILMAN STROUGH- What about the canopies on Main Street? SENIOR PLANNER, BAKER- We can keep canopies under design guidelines SUPERVISOR STEC- The information that Craig sent out regarding signs was resent to the APA as well as copies given to each of the Board Members. SPECIAL TOWN BOARD MEETING 07-12-2010 MTG. #26 961 COUNCILMAN MONTESI- Spoke regarding a conversation he had with Sean Garvey concerning the riffle club. CRAIG BROWN- Has also been in contact with Mr. Garvey and explained that the focus is on the proposed project at hand and meeting standards for that. The next workshop will focus on Articles 7, 9 and 10.
