TOWN OF QUEENSBURY SANITARY SEWER DISTRICTS
Supervisor Daniel Stec-Invited Mike Shaw the Wastewater Director to come up and brief the Board and
the public on what we are accomplishing here this evening. This public hearing was set at a board
meeting a couple of weeks ago and Mike if you would summarize what we are doing and why.
Wastewater Director Mike Shaw-We are here to increase the user fees the sewer rents that are billed
quarterly on all the districts in the Town of Queensbury. The reason we are increasing these is to pay
the towns share of the reconstruction of the Glens Falls Wastewater Treatment Plant. I will quickly go
over the rates, the new rates. In the Queensbury Consolidated District that is the old Highland Park
Central Queensbury Sewer District, the residential rate will be the first thirteen thousand gallons fifty
dollars, and over thirteen thousand gallons would be five dollars. Commercial Rate will be six dollars
and fifty cents per one thousand. Now for the rest of these districts, Route 9, South Queensbury,

Technical Park, Pershing Ashley Coolidge and West Queensbury their rates will be increased to five
dollars per thousand gallons.
Supervisor Stec-You did not mention it but just so that that public knows in the first case the
Consolidated Sanitary Sewer District that used to be Central Queensbury and Quaker Road, Hiland Park
that quarterly rate used to be thirty dollars and now it is fifty and then for the first thirteen thousand
then after that it used to be four and a half dollars and that was rounded to five dollars. Likewise for the
commercial it went from six dollars to six fifty again a quarter and likewise the other ones went from
three dollars and fifty cents to an even five dollars per thousand. So, they are modest increases but the
purpose of that again is to cover what Mike?
Wastewater Director Shaw-The reconstruction at the Glens Falls Wastewater Treatment Plant, we have
a share that we are going to pay for that.
Supervisor Stec-Which is one of the things that we are still trying to work out exactly what it is, we know
it is going to be something and this is anticipation of needing to pay that when it gets established.
Wastewater Director Shaw-Correct.
Supervisor Stec-Ok, with that said I will open the public hearing if there are any members of the public
that would like to comment on this public hearing, I just ask that you would raise your hand one at a
time and call on you and when you get to the microphone if you would state your name and address for
the record, these microphones not only amplify but they record for the purpose of the record. No one
spoke. Are there any Board Members that have any questions of Mike? Again, public comment?
Councilman Montesi-Mike the only question I have is we hired an auditor to do an audit of bills with
Glens Falls is that coming along?
Wastewater Director Shaw-We have hired the auditor he is waiting for data that he has requested from
the Glens Falls Wastewater Treatment Plant he is still waiting for the data so he can do his audit.

WHEREAS, the Queensbury Town Board wishes to consider adoption of Local Law No.: 11 of
2010 to amend Queensbury Town Code Chapter 136, Article XXIV entitled “Establishment of Sewer Rents,"
which Local Law would modify the quarterly sewer rent rates in the Queensbury Consolidated Sanitary
Sewer District (previously known as the Central Queensbury/Quaker Road Sewer District and Hiland Park
Sewer District), Queensbury Technical Park, Pershing-Ashley-Coolidge, South Queensbury-Queensbury
Avenue, Route 9 and West Queensbury Sanitary Sewer Districts, and
WHEREAS, this legislation is authorized in accordance with New York State Municipal Home Rule
Law §10, Town Law Article 16 and General Municipal Law Article 14-F, and

RESOLVED, that the Queensbury Town Board hereby enacts Local Law No.:11 of 2010 to amend
Queensbury Town Code Chapter 136, Article XXIV entitled “Establishment of Sewer Rents," as presented at
this meeting, and

RESOLVED, that the Town Board hereby authorizes and directs the Queensbury Town Clerk to file
the Local Law with the New York State Secretary of State in accordance with the provisions of the Municipal
Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing with the
Secretary of State.

"ESTABLISHMENT OF SEWER RENTS"
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF
QUEENSBURY AS FOLLOWS:
SECTION 1.
Queensbury Town Code Article XXIV, entitled “Establishment of Sewer Rates,”
Section 136-137 is hereby amended as follows:
§136-137. Charges established.
There is hereby established and imposed a scale of sewer rents for services rendered by the sewer system to
the real property within the limits of the following sewer districts as set forth below:
A. Charges pursuant to §136-135 hereof for the Queensbury Consolidated Sanitary
Sewer District (previously known as the Central Queensbury/Quaker Road and

Hiland Park Sewer Districts but such Districts were consolidated in September 2010
so it is now known as the Queensbury Consolidated Sanitary Sewer District):
(1)For residential properties: For zero to 13,000 gallons of metered water usage,
the charge shall be $50quarterly for each residential unit, plus $5.00per
thousand gallons of water consumption in excess of 13,000 gallons per quarter
as indicated by the current water meter readings, billed on a quarterly basis.
(2)For nonresidential properties: $6.50per thousand gallons of water consumption,
as indicated by the current water meter readings, billed on a quarterly basis.
B. Charges pursuant to §136-135 hereof for the Queensbury Technical Park Sewer
District:
(1)For all occupied properties: $5per thousand gallons of water consumption, as
indicated by the current water meter readings, billed on a quarterly basis.
C. Charges pursuant to §136-135 hereof for the Pershing-Ashley-Coolidge Sewer District:
(1) For all occupied properties: $5 per thousand gallons of water consumption, as
indicated by the current water meter readings, billed on a quarterly basis.
D. Charges pursuant to §136-135 hereof for the South Queensbury-Queensbury Avenue
Sewer District:
(1) For all occupied properties and contracted customers to the South Queensbury-
Queensbury Avenue Sewer District: $4 $5 per thousand gallons of water consumption, as
indicated by the current water meter readings, billed on a quarterly basis.
E. Charges pursuant to §136-135 hereof for the Route 9 Sewer District:
(1) For all occupied properties: $5 per thousand gallons of water consumption, as
indicated by the current water meter readings, billed on a quarterly basis.
F. Charges pursuant to §136-135 hereof for the West Queensbury Sanitary Sewer District:
(1) For all occupied properties: $5 per thousand gallons of water consumption, as
indicated by the current water meter readings, billed on a quarterly basis.
SECTION 2.
The invalidity of any clause, sentence, paragraph or provision of this Local Law
shall not invalidate any other clause, sentence, paragraph or part thereof.

SECTION 3.
All Local Laws or ordinances or parts of Local Laws or ordinances in conflict with
any part of this Local Law are hereby repealed.
SECTION 4.
This Local Law shall take effect immediately upon filing in the Office of the New
York Secretary of State.
2.0 PRIVILEGE OF THE FLOOR

Res. 3.6 It is confusing adopting new regulations and using the same Chapter numbers
without dedicating the revisions.
Supervisor Stec-Each page of the code reflects our revision date on it.

Our sign ordinance should recognize the fact that there are regulations under Article 43
of the Environmental Conservation Law-should be incorporated in the Code
?
For us in the Lake George School District in North Queensbury the school district had a
budget increase of 1.8%, speaking as a residential property owner, my school tax bill
went up 9% everything stayed the same I think the problem is the equalization rate.
Lake George equalization rate went from 58% up to 65% and that shifted the tax burden
so we in Queensbury are picking up that much more of the tax load. In Lake George the
school taxes went down 4%. Something is wrong with what we are doing. Lake George
was due to do a reval last year and did not, how did they get their equalization rate
from 58 to 65%?

Noted he listened to the comments made at the last meeting from two gentlemen from
the North Queensbury Fire Company, I foiled information from them and have not
received an answer yet. It was confusing when they introduced themselves as members
of the North Queensbury Volunteer Company was well as the Fire Fighters Organization.
They are two separate not for profit corporations and they are separate because they
have a different mission, they are not recognizing that.

Regarding Fire Companies, I have a copy of your contract with your audit firm that
audits the fire companies, they audit to statements and prepare their federal returns
and State returns, isn’t that a conflict?
Supervisor Stec-That is part of their contract.

There is talk about fire districting; whatever we do we don’t design it to fail. Need a
plan 1. There are major facilities that are fire tax exempt they get a fire service and they
should pay .
Councilman Strough-There is about two hundred and twenty five million dollars in tax
exempt properties in the Town of Queensbury and most of them are south of North
Queensbury.
2. Why don’t we go to a system of protecting the potential loss, why insure land, lets
base the fire tax on structures.

RESOLUTION APPROVING GRANT AWARDS FOR CASE #6197 IN CONNECTION
WITH TOWN OF QUEENSBURY
HOUSING REHABILITATION PROGRAM

WHEREAS, the Town of Queensbury has established a Housing Rehabilitation Program which
provides grants to cover 100% of the cost of rehabilitation up to a maximum of $25,000, whichever is
less, and
WHEREAS, the Town has received grant funds from the New York State Affordable Housing
Corporation Affordable Home Ownership Development (AHOD) and the New York State Office of
Community Renewal Community Development Block Grant (CDBG) programs to cover eligible project
costs, and
WHEREAS, a single family property Case File #6197 has been determined to be eligible for
rehabilitation grant assistance and the owner of the property has requested such assistance, and
WHEREAS, property rehabilitation specifications will be provided to a minimum of three (3)
qualified contractors for bid, and
WHEREAS, the low bid cost to complete the work specified is to be determined but will not
exceed twenty five thousand dollars and no cents ($25,000.00), and
WHEREAS, the low bid cost to complete the work specified will be verified upon receipt of
bidding documents, and
WHEREAS, Shelter Planning & Development, Inc. has overseen the grant process and has
verified that it has been followed in this case and recommends approving these grants, and
WHEREAS, a lien will be filed against the property for the benefit of the Town for a period of five
(5) years from the completion of the rehabilitation,
NOW, THEREFORE, BE IT
RESOLVED, that the Town of Queensbury approves a total grant award not to exceed twenty five
thousand dollars and no cents ($25,000.00) including an AHOD grant, as applicable, in the amount not to
exceed 60% of the total cost of rehabilitation for Case File #6197, Queensbury, New York, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs either the Town Supervisor or Town
Senior Planner to execute the Grant Award Agreements and take such other and further action as may
be necessary to effectuate the terms of this Resolution.

WHEREAS, the City of Glens Falls operates a public mass transportation system known as the
Greater Glens Falls Transit System (Transit System) which provides transit bus service within portions of
Saratoga, Warren and Washington Counties, and
WHEREAS, the Town of Queensbury’s current Transportation Agreement with the Transit System

will expire December 31, 2010 and the Transit System has submitted a new Transportation Agreement for
January 1, 2011 through December 31, 2012 to the Town for approval, and
WHEREAS, such Agreement provides for the continuance of an Advisory Transportation
Committee consisting of two members from the Transit System and two members from each participating
community, and historically the Town of Queensbury’s two representatives have been the Town Supervisor
and Senior Planner, and
WHEREAS, the Town Board believes that this public transportation service benefits and serves the
public interest of Town residents, and
WHEREAS, a copy of the Agreement has been presented at this meeting and is in form approved by
Town Counsel,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves the Transportation Agreement
between the City of Glens Falls’ Greater Glens Falls Transit System and Town of Queensbury presented at
this meeting for an amount of $51,992 annually for 2011 and the amount for 2012 will be set by the Advisory
Committee in 2011 (on which the Town has two representatives), to be paid from the appropriate account,
and

Rights and Grant of Easement Rights in substantially the form approved by Town Counsel in connection
with the Main Street Utilities Relocation Project, to National Grid, Verizon New York Inc., and Time
Warner Cable so that such companies could place their respective utility infrastructure underground
within the easement area, and
WHEREAS, National Grid has identified an additional easement it needs over certain Town
property adjacent to Media Drive, and
WHEREAS, the Town Board has the authority to assign and grant such easement in accordance
with New York State Town Law §64(2),

RESOLVED, the Queensbury Town Board hereby authorizes such non-exclusive assignment and
grant of easement, specifically authorizing the execution of the Assignment of Easement Rights and Grant of

Chapter 140 entitled “Signs,” and
WHEREAS, the Town must obtain approval of the Adirondack Park Agency for the proposed
revised Sign Code prior to adoption, and
WHEREAS, the Town of Queensbury amendments, as embodied in the proposed revised Sign Code,
comply with and are a furtherance of approval standards contained in §807 of the Adirondack Park Agency
Act and 9 NYCRR Part 582 of Agency regulations, and
WHEREAS, the revised proposed Sign Code must be reviewed under the State Environmental
Quality Review Act (SEQRA) prior to adoption, and
WHEREAS, the Town Board wishes to set a Public Hearing concerning adoption of this Local Law,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby declares its intent to be Lead Agency for
SEQRA review of the proposed revised Sign Code and authorizes and directs the Town Clerk or Senior
Planner to send copies of the proposed revised Sign Code, Full Environmental Assessment Form, and a
certified copy of this Resolution stating the Town Board’s intention to be Lead Agency for SEQRA review,
to the Adirondack Park Agency and any other Involved Agencies as required by law, and

BE IT FURTHER,
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town Clerk or
Senior Planner to formally submit the proposed revised Sign Code and supporting SEQRA documentation to
the Adirondack Park Agency for review and approval pursuant to Article 27 of the Executive Law, §807, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Clerk or Senior Planner
to forward a copy of the proposed revised Sign Code to the Lake George Park Commission for its review and
recommendations, and
BE IT FURTHER,
RESOLVED, that the Queensbury Town Board shall meet and hold a Public Hearing at the

Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m. on Monday, October 18, 2010 to
hear all interested persons concerning proposed Local Law No.: ___ of 2010 to repeal current Queensbury
Town Code Chapter 140 entitled “Signs,” and replace it with a new Chapter 140 “Signs,” which Local Law
provides for comprehensive Town-wide changes to the Town of Queensbury’s Sign Code, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Clerk to provide the
public with at least 10 days prior notice of the Public Hearing by causing a Notice of Public Hearing to be
timely published in the Town’s official newspaper and by posting the Notice of Public Hearing on the
Town’s bulletin board at least 10 days before the date of the Public Hearing, and
BE IT FURTHER
RESOLVED, that the Town Board further authorizes and directs the Town Clerk to send the Notice
of Public Hearing, together with copies of the proposed Local Law if necessary, to any public officials,
agencies or municipalities in accordance with any applicable State Laws or Town Code provisions, and
BE IT FURTHER
RESOLVED, that the that the Town Board further authorizes and directs the Town Clerk and/or
Town Counsel to take such other actions and give such other notice as may be necessary in preparation for
the Town Board to lawfully adopt proposed Local Law No.___ of 2010.

4.0 CORRESPONDENCE
4.1
Audit from State Comptrollers Office on Real Property Tax Collections and Remittances in
Warren County - Supervisor Stec-This was a two page audit report they found no issues with the tax
collections in the Town of Queensbury, so Darleen hats off to you. Councilman Strough-In reading the audit
I was very impressed and proud of Darleen’s Office and the credit we were given for doing everything like
we are supposed to do by the book we got a clean bill of health, not everybody did. Darleen Dougher-

Turned over to the Town Board the Supervisor’s Tentative Budget for 2011.
5.0 TOWN BOARD DISCUSSIONS
Supervisor Stec-

Thanked all the Department for their preparation of their budgets a special thanks to
Queensbury Parks and Recreation and Commission cut their budget by about 10% and the
Highway Dept. cut their budget by 7 or 8%. Noted the retirement contribution will be going
up 30% in 2011 and health care is estimated to go up 17% if it wasn’t for those two items
the general fund would have been down. Regarding the Highway Dept. of the nine towns
that I looked at the Queensbury Highway Dept. cost per mile for maintenance is the lowest
now. Tentative Budget has a projected Town Tax of 65 cents per thousand. The Town has
not had a Highway Tax for many, many years, and has not had a general town tax for the last
nine years, we will continue to not have a Highway tax. Comparing with other
communities, the town’s budget is still one of the most frugal ones in the area and our tax is
one of the lowest in the area. The Tentative is now turned over to the Town Board for their
review. The public hearing to be scheduled sometime in November.

Councilman Brewer-

Aviation Mall-Requested that the Town Board starts Supreme Court Action on the removal
of their buildings on Aviation Road, it does not appear that they are going to meet their
deadline.
After Town Board discussion it was the opinion of the Board to go ahead with Supreme
Court Action, Supervisor Stec will be contacting Town Counsel on this issue. Councilman
Strough-Noted that the Planning Board is concerned also with the cleaning up of the old
Howard Johnson’s site. Attorney Lapper, Counsel for Pyramid will be presenting a letter to
the Planning Board regarding the cleanup issue. Supervisor Stec-Noted he had spoken to
Attorney Lapper-he does have a letter indicating if Pyramid gets their site plan approval
within 45 days they will have closed and within twenty days after that they will begin
demolition.
Councilman Strough-

Reviewed the activity report from the Fire Marshal’s Office for the month of August. 15%
of all the inspection report received violations and needed follow up action by this office.
Month of July 28 commercial inspections, 44 re-inspections commercial and 20 life safety
inspections, solid fuel equipment inspections 5, field activity 28, public education 2 and 278
phone calls. Alert the Community that now is the time for service to be performed on your
heating devices. Be sure your home is equipped with functioning CO devices. Also noted
by the Fire Marshal’s Office that they can no long issue burning permits, this must be
obtained through DEC.

In the issue of September 24 Lake George Mirror there is an article that fall is a good time
to plant shore line buffers. The duck and goose problem at Pine View Cemetery may be
taken care of by letting the area over grow and planting a buffer by the road.

Spoke on the drainage work on Quaker Road by Trinity Construction…the work is done and
the water is flowing through the pipe.

The County is looking at the Airport for a potential site for housing for sex offenders, I have
concerns about that.
Councilman Metivier-

Spoke about the drainage situation on Hillman Road, we have decided to go forward with
Phase I construction.

Lake Sunnyside Aquatic Management Dist.-looking for site on the lake to work from.
