The subject property consists of a lawful nonconforming (shoreline setback, Permeable Area) single-family residence with an existing deck on the east side of the structure. The project involves the replacement of the existing deck with a new deck structure that expands to the east and north. We will be seeking area variances for the expansion of the lawful, nonconforming residence which will result in a decrease in Permeability to 70.3%, this decrease is generated from the proposed deck extending over the existing permeable block pavers underneath the proposed structure. Relief is also requested for Shoreline Setback (existing deck is 47’ from shoreline, proposed deck is 42’ from shoreline) vs. the 50’ allowed. The applicant is also proposing a slight encroachment into the side yard setback, 19’ is requested vs. the 20’ allowed. All required application documents including site plans, deck building plans, Area Variance Application, deed, survey, and application fee have been complied in the Area Variance Package. A waiver from Area Variance submittal requirements for non-residential items (square footage building usage breakdown, signage, lighting, etc.) info is herein requested. Site Plan Review will be required as development will involve expansion of the nonconforming residence which is within a CEA.
