Dear Mike,
Enclosed for your review are revised Site Plans and Building Plans for the Area
Variance for the proposed garage for the McCormick's at 18 Dark Bay Lane. In respect to
the plans, please note the following changes:
1) The location of the garage has been moved to the west side of the existing
basketball court, therefore closer to the house, which shortens the driveway
and reduces the area of disturbance to less than 11,000 SF. It also moves the
garage outside of the critical environmental area(CEA)but it is still within 50
feet of the CEA.
2) The size of the building has been reduced from 3,113 SF to 1,995 SF and the
number of bays has been reduced from 8 to 3. The height of the building
remains at 16 feet.
3) The bathroom, the well and the septic tank has been eliminated.
4) Since the amount of disturbance has been reduced to less than 11,000 SF and
has been moved out of the CEA, the amount of stormwater runoff has been
likewise reduced and stone diaphragms have been provided to mitigate the
increase.
Please note the following:
1) The McCormick's own 4.7t acres in this parcel and also own two adjacent
parcels totaling an additional 1.12t acre. Therefore,he could subdivide the
property or do a lot line amendment to obtain a lot suitable for a larger house
with a larger garage and including a well and septic system.
2) Dark Bay Lane is a private road owned by the adjoiners. In this case, the
McCormick's.
3) Immediately to the east of the McCormick's property, a very similar variance
request which was approved in February by the ZBA(Area Variance No. 8-
2021). That property was smaller in size, 3.4f acres vs. McCormick 4.7f
acres, the garage was in the CEA, the garage was taller, the garage square
footage was larger, and the owner intends to do maintenance on his vehicles.
The McCormick's will not be doing any maintenance or repairs at the garage.
4) Section 179-5-20-D of the Zoning allows a garage of 2,200 SF on lots over 5
acres. In total, the McCormick's own 5.8t acres.
5) The McCormick's are now permanent residents at 18 Dark Bay Lane.

April 21, 2021 meeting.
