Also, I have reviewed the historical record pertaining to this subdivision as well as the file associated with Area Variance 85-1999, which you referenced in your letter. As such, I would offer the following information: In 1981 the original Southern Exposure subdivision,which proposed a 36-lot development, was first reviewed by the Town of Queensbury Planning Board. The Planning Board subsequently approved the subdivision in 1982. Unfortunately, the requirement which necessitates that a subdivision, once approved, must be filed at the Warren County Clerks Office within 60 days was not followed. Subsequently,this initial subdivision approval expired as a result of the inaction. Later in 1982 the Town of Queensbury adopted a new zoning ordinance. The new zoning ordinance altered the zoning of the subject property from R-3, to SR-30. This redistricting presented several changes in the requirements for this property. The substantive changes were: R-3 R-30 Front setback 30 ft 30 ft Rear setback 30 ft 20 ft Side setback 5 ft min / total 15 ft 10 ft min / total 30 ft Minimum lot size 12,000 sf 30,000 sf In 1983 the developer attempted to begin construction on a lot in the subdivision only to discover, apparently, that the map had not been filed and that the approval had expired. At that time, the developer applied to the town for a re-approval of the subdivision and was informed that the zoning ordinance had changed and that an Area Variance would be necessary to develop lots less than 30,000 sf in size. The developer applied for and was granted a variance to develop lots less than 30,000 sf. No request was made by the developer at this time to alter the building setbacks for the lots. Section 179-20-010,B. of the Town of Queensbury zoning ordinance states: B. Development of any nonconforming lots of record wbicb are located within Planning Board approved subdivisions shall be considered as complying with the setback requirements of this chapter if the setback requirements applicable at the time the subdivision was approved are met. However,upon review of the record for this subdivision and the subsequent modifications thereto,it appears as though the intent of both the Zoning Board of Appeals and the Planning Board was to grant an approval or re-approval for the original subdivision as it was originally presented in 1981.
