Haviland Acres Subdivision No. 9-75, Donald and Helen Martell, Developers - 5 lots north side of Haviland Road. Joseph Brennan, Town Attorney, Brian Fear, New York State Health Dept. representative and John VanDusen were present on this matter, as well as the developers and several of the property owners. Motion by Montesi seconded by Mann to grant final approval of this subdivision. Motion carried unanimously. The Board reaccepted the map for filing and signing with understanding that Health Department approval of sewage disposal be met on a lot by lot basis. Mr. Roberts, Chairman to sign the map of Haviland Acres No. 9-75 for final approval and file in Town and County Clerk's offices. Also, each lot must have individual approval of New York State Department of Health for sewage disposal units before building permit will be issued. Map must be amended to include the specific requirement that New York State Health Department approval must be approved on a lot by lot basis before building permits granted. 3. Public Hearing Subdivision No. 3-81, Brierwood Close, Wm. Kostechko, Developer - 15 lots off Aviation Road-east of Eldridge Road. Tom McCormack present on this subdivision. Motion by Sorlin seconded by Mann to grant Final Approval. Motion carried unanimously. 4. Off-Premises Sign: No. 12, B.P.O.E.(Elks Club) - Harry Moon property corner Bay and Cronin Roads. Motion by Montesi seconded by Mann to grant this Off-Premises Sign. Motion carried unanimously. 5. Varia.nce NO. 716, KrUps"ak,ZÖbelandJUng - to place a dock as an accessory use without a principal structure on lot in R-l Zone on the property situated at Route9L, Dark Bay on Lake George. John Matthews represented applicants. Motion by Mann seconded by Dybas to recommend approval of this use variance. Motion carried by vote 4 yes and 1 no. The Board recommend approval based on the following: 1. Three families purchased this lot as right-of-way to build dock for their own boats. 2. Variance would limit dock to one dock with 3 slips. 3. Board agrees with restriction placed on this lakefront lot by Adirondack Park Agency, that no residence will be built on this lot. 6. Variance No. 717, George S. Ferris, Jr. - to divide property creating one conforming lot and one non-conforming lot in square footage on the property situated at Cleverdale Road on Lake George. Attorney Robert Stewart was present representing the applicant. Motion by Sorlin seconded by Montesi to recommend approval of this area variance. Motion carried unanimously. The Board recommend approval of this area variance as it will not affect the character of the neighborhood. The Board is considering the maximum lot size, without considering dock filled with earth, to be 8800 sq. ft. Therefore, any findings by the Zoning Board of Appeals as to what constitutes land area is not our concern. The Planning Board just considering variance for a building lot of 8800 sq. ft. QUEENSBURY TOWN PLANNING BOARD MEETING JUNE 3, 1981 Page 2 7. Variance No. 718, Cale Glens Falls, Inc. - to allow light industrial use in C-3 Zone on the property situated at Northway Plaza, Route 9. Attorney, Robert Stewart present for applicant. Motion by Dybas seconded by Mann to table for one month for more information. Robert Stewart to arrange a meeting with the Planning Board, Zoning Board, Town Board and repesentatives of Cale Development to review this proposal. 8. Special Permit No. 98, Cale Glens Falls, Inc. - for a large scale industrial development on the property situated at Northway Plaza Route 9. Motion by Dybas seconded by Mann to table for more information (see Variance No. 718 above). 9. Variance No. 719, David Aronson - to place a swimming pool partially in side yard in lieu of required rear yard placement on the property situated at 17 Ashley Place. David Aronson and Bob Baker present. Motion by Sorlin seconded by Montesi to recommend approval of this area variance. The applicant has shown practical difficulty in that he has no backyard.
