1988-09-26 SP >- -" QUEENS BURY TOWN PLARlfIBG BOARD SPECIAL Meeting: Monday, September 26, 1988 at 4:00 p.m. Present: Richard Roberts, Chairman Joseph Dybas Peter Cartier Frank DeSantis Susan Levandowski Victor Macri Paul Dusek, Counsel Mary Jane F. Moeller, Stenographer Absent: Hilda Mann, Secretary Mr. Roberts called the meeting to order at 4:00 p.m. and explained that this meeting was a Map Amendment to Stone Gate Manor Subdivision Plat, whereby the Kiwanis Club and BOCES would like to make two lots out of three lots. On the advice of the Town Counsel. it was felt that a Public Hearing would be necessary to protect any legal issue. HEW BUSIRESS SITE PLAN HO. 49-88 Glens Falls Kiwanis Club, Inc. This application is for the division of Lot No. 16 of Stone Gate Manor to be added to Lot No. 17, yielding l65 ft. x 219.99 ft. (equals 36,298.35 sq. ft.) for the construction of a house by the BOCES students. At pre- sent the lot is vacant. Representatives present: Judge David Little Kenneth Baker Skip Potter Counsel President, Glens Falls Kiwanis BOCES Team Leader Judge Little explained that Lots l5, l6 and l7 in Stone Gate Manor were originally purchased with the intention of constructing three resi- dences by BOCES students. This type of project has been ongoing for approximately ten years. In the development of the program last year, it was felt that Lot l5 was not big enough to handle the house, therefore, an application was made to build on Lot lS and one-half of Lot 16. The home was constructed and the proceeds went to financially reimburse BOCES for equipment and materials, and the remainder for charitable utilization. When the Building Permit was applied for recently in 1988 to build on the remaining one-half of Lot l6 and the entire Lot l7, the fact that an alteration to an approved subdivision plot had been noticed. At the same 1 time, 21 BOCES students were put on hold with their school project, there- fore, the reason for the Special Meeting. Because of the division of Lot l6, there is an increase in the lot size by 55 feet in width, over what was legitimate and allowed previously. Mr. Roberts said that David Hatin, Building/Codes Supervisor. was uncom- fortable in issuing a Building Permit, without Planning Board approval. In addition, the Town Attorney requested a Public Hearing. Judge Little stated that only a Building Permit was received in 1987, even with the division of Lot 16. The applicants have met all the side setback requirements and provisions of the Town of Queensbury ordinances. Seconded by Mr. Cartier.
