Project Description
Applicant requests to maintain a 188 sq. ft., 10 ft. high shed to replace a shed that has been removed. The
existing home is 4,259 sq. ft. (footprint) with a floor area of 3,931 sq. ft., which includes 188 sq. ft. shed.
Pursuant to Chapter 179-6-065 of the Zoning Ordinance, new floor area in a CEA shall be subject to Planning
Board review and approval.
Requested Action
Recommendation to the Zoning Board of Appeals to maintain a 188 sq. ft., 10 ft. high shed to replace a shed
that has been removed. In addition, the permeability has been increased
Staff Comments
Location-The project is located at 312 Glen Lake Road on a 20,578 sq ft parcel.
Arrangement- The site has an existing single family home 4259 sq ft footprint and the shed to remain is 188
sq ft.
Site Design- The applicant has indicated the previous shed was removed in June 2019 and the new shed was
put in the same place.
Building – There are no changes to the existing home and the 188 sq ft shed is to remain in the current
location.
Site conditions-The placement of the shed is within 50 ft of the shoreline where hard surfacing within 50 ft
of the shoreline requires site plan review. The applicant has proposed to remove 687 sq ft of pavement and
replace with tuff-stone product to increase permeability.
Grading and drainage plan, Sediment and erosion control-The photos show a pitched roof where water
would pitch on either side of the shed.
Landscape plan-The applicant has not indicated any new plantings and the Real Property photos on file
indicate trees and shrubs near the shoreline and plantings. Below are the guidelines from the shoreline
buffer code section, Section 179-8-040 .
-Minimum width 20 ft (Glen Lake)
-For every 700 sqft of shoreline buffer area –one large tree minimum 3 inches in diameter
-For every 350 sq ft of ground cover -7 – 24 in native shrubs; 14 herbaceous plants
Project site
-129.34 ft of shoreline per survey
-Shoreline buffer 129.34 ft X 20 ft width is 2,587 sq ft
-Shoreline buffer area -2587 /700 = 3.7 round up to 4 –three large trees at 3inch diameter
-Ground cover -2587/350 =7.4round up to 8 (X7) =56 native shrubs and 8 (X14) herbaceous plants=112
Utility details-The applicants septic and waterline from Glen Lake remains the same no changes have
occurred.
Elevations-The applicant has provided photos of the shed and has indicated it is 10 ft in height.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Nature of Variance
Granted 5/19/2021 with condition updated survey and site data sheet be provided. The storage shed is proposed
to remain at 3.9 ft setback from the side property line where a 20 ft setback is required. Shoreline setback is
requested where 44 ft is to remain and 50 ft setback is required. Permeability is proposed to remain to be
improved to 65.8 % where 64% was proposed and where area variance AV71-1994 granted permeability at
69%. Relief for floor area is also requested where 5,962 sq ft floor area is existing with the shed and the
