Requested Action
Recommendation to the Zoning Board of Appeals to install new shoreline planting plan, create a designated
lawn area at the shoreline, install a stormwater management area for the existing driveway, replace brick patio
area with permeable patio areas, increase permeable patio areas at the shoreline, create a new hot tub area and
install slab steps.

Project Description
Applicant proposes to install new shoreline planting plan, create a designated lawn area at the shoreline, install
a stormwater management area for the existing driveway, replace brick patio area with permeable patio areas,
increase permeable patio areas at the shoreline, create a new hot tub area and install slab steps. The cabana is
pre-existing and needs review for location. Pursuant to Chapter 179-3-040, 179-4-010, 179-6-050, 179-6-060 &
179-8-040 of the Zoning Ordinance, waterfront area work, filling, slopes/cut activities and shoreline buffers
Variance:
shall be subject to Planning Board review and approval. Relief is sought for setbacks. Planning
Board shall provide a recommendation to the Zoning Board of Appeals.
Staff Comments
Location-The project is located at 57 Fitzgerald Road on Glen Lake. The parcel is 0.74 ac.
Arrangement- The existing home was constructed in 1995 and is to remain as is. The 168 sq ft cabana had
been constructed after that time but was not part of a review.
Site Design- The project includes redesigning a shoreline frontage area that occurs on steep slopes.
Building – The existing home is 5,578 sq ft with a porch/deck being removed
Site conditions-The site has an existing home and is located on a steep slope
Grading and drainage plan, Sediment and erosion control-The applicant proposes to improve the property
with removal of the pea gravel around the base of the home with mulch to increase the permeability on the
site. The project includes grading and filling an area to create a lawn area with approximately 563 CF. The
project has been referred to the Town Engineer for review and comment.
Landscape plan-The project includes revegetation of the steep slope area between the shoreline and the
house.
Site lighting plan-The existing residential lighting along the path from the home to the shore are to be
removed.
Utility details-There is no change to the existing utility – septic or portable water.
Elevations, Floor plans- There are no changes to the existing home and structures.
Waivers-Planning staff has reviewed the applicants request for waivers that include items h. signage, n
traffic, o. commercial alterations/ construction details, q. soil logs, r. construction/demolition disposal s.
snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects. The applicant has provided information for g. site lighting, j.
stormwater, k. topography, l. landscaping, p floor plans.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Nature of Variance
The site has an existing cabana of 168 sq ft that is 6.2 ft from the shoreline where a 50 ft setback is required.
The home was constructed in 1995 and the cabana was constructed after with no approvals with building and
codes or planning and zoning.
Summary
The planning board is to provide recommendation to the Zoning Board for an after the fact construction of a
cabana for shoreline setbacks.
