HElICE, THE NECESSITY FOR THIS MEETING, Introduced by James Hagan who moved for its adoption, seconded by Nicholas Caimano: Duly adopted this 31st day of December. 1990. by the following vote: AYES: Mr. Martin, Mr. Caimano, Mr. Hagan, Mr. Cartier NOES: NONE ABSENT: Mrs. Pulver. Mr. LaPoint, Mr. Kupillas MR. CAIMANO-They had quorum to vote in the minutes. MR. GORALSKI-They couldn't vote on a Special Meeting for this project. MR. CAIMANO-Okay. MR. CARTIER-Just let me see if I can pick out the issues. here. They have a letter requesting. and they wanted this included in the motion. the recreation fee not be paid until, what, they get CO's on each individual house? MR. GORALSKI-Right. and you cannot address that issue. MR. CARTIER-So. we don't have to worry about that. MR. GORALSKI-That is a Town Board issue. MR. CARTIER-Okay. And we also have a recommendation that the motion include approval of Phase I only and that the infrastructure for both Phase I and Phase II be included and also. I'm not sure how we want to word this, here. We want to becareful with this. They also have to submit a Homeowners Association Agreement that has to be approved by the Attorney General's office. MR. GORALSKI-That's right. MR. CARTIER-Now. my question is. if we make our approval contingent on the acceptance of that Homeowners Agreement. what does that do to the applicant, in terms of having final approval? 1 '-" ..--' MR. HAGAN-May I interject, here? I don't think that's necessary because that's normal procedure and if the Attorney General's office does not approve it. anything we say is actually denied. MR. GORALSKI-And it's also part of the re-zoning. so that the re-zoning would not be effected if the Homeowners Association documents were not submitted to the Attorney General's Office. MR. CARTIER-So. do we have to address that at all. in the motion? MR. GORALSKI-My opinion is that you can. if you want to, but you don't have to because. A. There's no project if it's not approved by the Attorney General's Office. MR. HAGAN-What good does it do? MR. GORALSKI-Right. there's no project if they don't get it approved by the Attorney General's Office and there's no re-zoning if the Homeowner's Association documents are not approved. MR. ADAMS-It would also be in violation of the filings of the County Clerk. in terms of title clearance and stuff like that. MR. CARTIER-So, I guess we're reduced. then, to the issue of the Phase I and II infrastructure. MR. CAIMANO-Right. We're going to approve Phase I with the infrastructure for the entire project. MR. CARTIER-Correct. and there was a comment, also. to the effect, somewhere, that clearing in the Phase I section only be done..all the infrastructure. So we're not clearing lots. So, if anybody's prepared to make the motion. MOTION TO APPROVE FINAL STAGE SUBDIVISION NO. 14-1990 INSPIRATION PARK, Introduced by James Martin who moved for its adoption. seconded by James Hagan: For a 42 lot subdivision, with the following stipulations: That only the Phase I portion of the project is included in this approval, but will include all the necessary infrastructure for both Phase I and Phase II as shown on the Site Plan. That only Phase I of the Site Plan be approved for clearing and that the only clearing to take place in Phase II is that which is necessary for the infrastructure. Duly adopted this 31st day of December. 1990. by the following vote: AYES: Mr. Hagan. Mr. Martin, Mr. Caimano. Mr. Cartier NOES: NONE ABSENT: Mrs. Pulver. Mr. LaPoint, Mr. Kupillas MR. CAIMANO-Again, for the record, I apologize to the applicant and the Board for my absence. reasons beyond my control. MR. ADAMS-For the record.
