Mr. John Salvador-Resident of North Queensbury-RE: Sewer Variance for Sharon Davies
Hearing held on May 16, 2011 - I commented that the applicants submission did not meet the
requirements of Section 136-19 to furnish the legal description of the property 239.19-1-9.
I do not know Mr. Hafner’s findings?
Supervisor Stec-I have heard from Town Counsel, the condition of our approval has been
satisfied that Mr. Hafner has been satisfied by the documentation that Ms. Davies was correct
and had the authority to sign the application.
Mr. Salvador-Why can’t the public record reflect that?
Supervisor Stec-It does now.
Mr. Salvador-The County record. The County has a service over there, an agency a State agency
that makes a determination as to ownership of property and they use deeds and maps, in this case
this parcel of land does not. RE: Wastewater District-Rockhurst - Has a meeting been
established?
Supervisor Stec-No, it hasn’t and I do not know when or if that will happen but if it does we will
be announcing it.
Councilman Montesi-What is your feeling on that, John?
Mr. Salvador-Boy, do we need something, we do not need another false start.
Councilman Montesi-What was the resistance to so many people of the project?
Mr. Salvador-If you are able to get a permit through a variance procedure to have an onsite
wastewater system why would you go through the trouble of supporting a taxing district?
Councilman Montesi-There is reluctance on our part when eighty people in a room saying they
do not want it.
Mr. Salvador-You should take the leadership role because we need it. Re: Service contract with
Fort Ann?
Supervisor Stec-I did send a letter to the Supervisor of Fort Ann it has not been taken up, next
time I have an opportunity to mention it to her I will.
Mr. Salvador-I do not think a contract is a solution to the problem why should the citizens of the
greater Fort Ann Town be willing to support the payment of a contract amount to the Town of
Queensbury to furnish emergency services for one little part of a town? You may have to go to a
taxing district; they may have to go to a taxing district.
Mr. George Winters-John Clendon Road – Re: Hudson River Park this time someone went in
and tore it up and they had the troopers there, I think from now on it should be handled by police
enforcement.
Supervisor Stec-That is a decision for the Sheriff to make, a decision for law enforcement to
make at the scene, at the time, however they want to handle it is fine with us.
Councilman Brewer-For the record it wasn’t not only Tim’s decision.
Mr. Winters-In the future let the police handle it.
Councilman Brewer-Hopefully this is not something that happens every three months, it was an
incident that happened that I happened to be there, the police asked Steve and I what we wanted
to do.
Supervisor Stec-It could have been handled either way.
Councilman Montesi-The good thing is the kids were there last Saturday and they did fix it.
Mr. Charles Baker-749 West Mt. Rd. – RE: Cemetery upkeep - noted Pine View Cemetery and
the Cemetery at the Corner of Bay and Quaker were the only cemeteries mowed…noted West
Mountain Cemetery with thirty four veterans there was not done until after Memorial Day…no
respect was shown at all.
Supervisor Stec-Between the rain and being short staffed, we had a retirement and a death we
had a temporary employee that quit after day one.
Mr. Baker-Noted in 2009 there was a three man crew at the cemetery. Noted that the last snow
storms the cemetery was not plowed, he helped some elderly women get their stuck car out of
the cemetery. Whether you have one man or twenty men it wouldn’t take ten minutes to plow
that out.
Supervisor Stec-I agree they fell down on the last couple of snow storms.
Mr. Baker-Two weeks before Memorial Day you hired two men for the cemetery, these jobs
should have been filled previous to this.
Supervisor Stec-We have a process that we need to follow, a union contract to deal with,
financial realities to deal with and like I said we had a death and retirement the cemetery does the
best they can, they far exceed the State minimums.
Mr. Baker-My main concern there wasn’t even an effort made and those thirty four vets that are
in that cemetery
Supervisor Stec-Like I said as a veteran myself unacceptable and I apologize for it but between a
month of rain and two days worth of dry weather before memorial day we barely got Pine View
mowed in time.
Mr. Baker-Budget for Pine View 2010 $557,259. 2011 $ 540,733.40 not a lot savings there.
The budget is there they had the money you could have hired …
Questioned who negotiates the contracts and who hires?

2.0 RESOLUTIONS
RESOLUTION ENACTING LOCAL LAW NO. 4 OF 2011 TO AMEND
QUEENSBURY TOWN CODE CHAPTER 179 “ZONING” AND TO
REZONE LANDS OF BRAYTON
RESOLUTION NO. 197, 2011

WHEREAS, the Queensbury Town Board has received a request to change the zoning designation of
parcel 300.16-1-6 located at 237 Fuller Road, Queensbury and currently owned by Barbara and Joseph
Brayton from Moderate Density Residential (MDR) to Land Conservation (LC) – 10 Acres and the Town
Board wishes to consider certain changes to the Town’s Zoning Code, as detailed in drafts of revisions to
Chapter 179, “Zoning,” of the Town Code presented at this Town Board meeting, including a proposed
revision to the Town’s Zoning Map associated with the Zoning Code (collectively, the “proposed zoning
revisions”), and
WHEREAS, the Town Board wishes to consider adoption of a Local Law, to be designated “Local
Law No.: 4 of 2011,” to amend Queensbury Town Code Chapter 179 “Zoning,” including a revision to the
Town’s Zoning Map associated with the Zoning Code, to revise §179-5-040(D) to specify that within the RR,
PR and LOC Districts, large farm animals such as cows, horses and swine may be kept provided that there is
a minimum of 10 acres rather than 25 acres, in accordance with the proposed zoning revisions presented at
this meeting, and
WHEREAS, in accordance with General Municipal Law §239-m, before enacting the proposed
zoning revisions the Town must first refer them to the Warren County Planning Board for its
recommendations, and
WHEREAS, in order for the Town’s Zoning Code to maintain its status as an approved local land
use plan under Adirondack Park Agency (APA) Act and APA regulations, the Town must obtain APA
approval of the proposed zoning revisions prior to adoption, and
WHEREAS, the proposed zoning revisions comply with the requirements of §807 of the APA Act
and 9 NYCRR Part 582 of APA regulations, and
WHEREAS, such proposed legislation is authorized in accordance with New York State Municipal
Home Rule Law §10 and Town Law Article 16, and

WHEREAS, on April 4, 2011, by Resolution No.: 139, 2011, the Town Board declared itself Lead
Agency for the required SEQRA environmental review for the proposed zoning revisions and prepared Part 1
of a Full Environmental Assessment Form (EAF) for use in the environmental review, and
WHEREAS, Municipal Home Rule Law §20 requires the Town Board to hold a public hearing
prior to the adoption of any Local Law and the Town Board duly held a Public Hearing on Monday, April

18, 2011 concerning proposed Local Law 4 of 2011 and heard all interested persons, and
th
WHEREAS, on April 18, 2011, by Resolution No.: 150, 2011, the Town Board, as SEQRA Lead
Agency, reviewed the Full Environmental Assessment Form to analyze potential environmental impacts of
proposed Local Law 4 of 2011, determined that it would not have any significant adverse impact on the
environment and declared and authorized the filing of a SEQRA Negative Declaration, and
WHEREAS, in accordance with General Municipal Law §239-m, the Town duly referred the
proposed revised zoning revisions to the Warren County Planning Board, which has not provided a report or
recommendation about them, and more than thirty days have elapsed since the Town’s referral to the Warren
County Planning Board, and
WHEREAS, the Adirondack Park Agency has approved the proposed revised zoning
provisions, and
WHEREAS, the proposed Local Law is in a form approved by Town Counsel,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby amends the Town of Queensbury Zoning
Law and Map to change the zoning designation of parcel 300.16-1-6 located at 237 Fuller Road, Queensbury
and currently owned by Barbara and Joseph Brayton from Moderate Density Residential (MDR) to Land

take effect upon such filing, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Queensbury Town Clerk to
send a copy of this Resolution and a copy of the Local Law and Zoning Map to the Town Planning Board,
Town Zoning Board of Appeals, Town Zoning Administrator and Warren County Planning Board in
accordance with §179-15-080(D) of the Town Zoning Law, and
BE IT FURTHER,
RESOLVED, that all applications requiring the review and approval of the Town of Queensbury’s
Zoning Administrator which are received and deemed complete prior to the effective date of this Local Law
shall be reviewed under the zoning regulations applicable at the time of such applications, and all applications
requiring the review and approval of the Zoning Administrator received after the effective date of this new
Local Law No.: 4 of 2011 shall be reviewed according to the zoning requirements established by this Local
Law, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Clerk and/or Senior
Planner and/or Town Counsel to take any and all action necessary to effectuate all terms of this Resolution.

A LOCAL LAW TO AMEND CHAPTER 179 “ZONING” OF QUEENSBURY TOWN CODE
TO AMEND OFFICIAL TOWN ZONING CODE
AND ZONING MAP
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF QUEENSBURY AS
FOLLOWS:
§
SECTION 1. Queensbury Town Code Chapter 179, “Zoning,” 179-5-040 entitled "Agricultural
uses," Section (D) is hereby amended as follows:
§ 179-5-040. Agricultural uses.
A. Within any ESC, CI, CM, CLI, HI, MDR, MS, NR, NC, O, RC, or WR District, the keeping of livestock,
poultry, fowl, including but not limited to emus, lamas, alpacas, ostriches or any large or small
farm animals, shall be prohibited. This prohibition shall also apply to established PUD’s unless
specifically noted in the adopted PUD agreement.
B. Within any district other than those cited in Subsection A above, poultry, fowl or small farm
animals such as sheep or goats may be kept, however, not including swine or cows, provided that:
(1) The property is a minimum of five acres.
(2) The animals must be housed at least 50 feet from any property lines.
C. Within any district other than those cited above, large farm animals (such as horses, ponies, cows
or swine) may be kept for private, noncommercial use, provided that there is a minimum of five
acres for the first animal and a minimum of two additional acres for each additional animal. The
animals must be kept a minimum of 100 feet from any property line.
D. Within the RR, PR and LC Districts, large farm animals such as cows, horses and swine may be
kept, provided that there is a minimum of 10 25 acres.
SECTION 2. Queensbury Town Code Chapter 179, “Zoning,” is hereby amended by amending
the official Town Zoning Map to reflect a change of zone for a parcel of property located at 237 Fuller Road
from MDR to Land Conservation (LC) – 10 Acres such property bearing Tax Map Parcel No.: 300.16-1-6.
SECTION 3. The Map appended to this Local Law is hereby adopted as the official Town Zoning
Map of the Town of Queensbury and supersedes the previously adopted Town Zoning Map.
SECTION 4. The invalidity of any clause, sentence, paragraph or provision of this Local Law shall
not invalidate any other clause, sentence, paragraph or part thereof.
SECTION 5. All Local Laws or ordinances or parts of Local Laws or ordinances in conflict with
any part of this Local Law are hereby repealed.
SECTION 6. This Local Law shall take effect immediately upon filing in the Office of the New
York Secretary of State as provided in New York Municipal Home Rule Law §27.
RESOLUTION AUTHORIZING COMMENCEMENT OF
SUPREME COURT ACTION AGAINST DONALD DANIELS

WHEREAS, Donald Daniels owns property at 19 Newcomb Street in the Town of Queensbury, tax
map parcel no.: 309.10-2-68, and
WHEREAS, the property appears to be occupied by an unknown tenant and the Fire Marshal
reports that inspections have not been performed which would allow a certificate of occupancy to be
issued for the current tenant and it appears that the current tenant is performing auto repairs at this
address without a certificate of occupancy, and
WHEREAS, Town records indicate that in 2004 the property was used as an auto glass store, and
other tenants occupied the property after that date, but there is no current certificate of occupancy, and
WHEREAS, the Town’s Director of Building and Codes Enforcement, David Hatin, reports to the

Town Board that he visited the property at 19 Newcomb Street on or about September 17, 2010 and
observed two or more unregistered, old or secondhand vehicles, accumulated trash and automobile
parts stored and deposited on the land, and
WHEREAS, the property constitutes a junkyard pursuant to Queensbury Town Code §102-2, and
WHEREAS, Mr. Hatin searched Town records and no license to operate, establish or maintain a
junkyard has been issued for this address, further the land is of insufficient size to permit a junkyard, and
WHEREAS, Mr. Hatin reports that he has made repeated attempts to obtain voluntary compliance
with the Town Code but the property owner has resisted, and
WHEREAS, the property owner is represented by counsel and due to a conflict of interest, the
Queensbury Town Court is unable to hear the charges and this results in delay because matters must be filed
in Queensbury, transferred to the City of Glens Falls, and the City Court will not allow additional charges to
be filed without repeating the procedure, and
WHEREAS, it is evident that the property owner will delay the proceedings to avoid determination
of the merits and will not address the underlying problem, namely, the accumulation of junk and debris and
the operation of an unlicensed junkyard, and
th
WHEREAS, Mr. Hatin most recently visited the property on May 25, 2011 and reported ongoing
violations as follows:
1. numerous unlicensed, unregistered vehicles;
2. car parts, including but not limited to numerous tires and other debris strewn about the
property;
3. activities suggesting that an auto business was taking place without a certificate of
occupancy; and
4. a large, uncovered container of junk and garbage;
and
WHEREAS, the Town is extremely concerned that the accumulation of junk constitutes a peril to
human health, and
WHEREAS, Queensbury Town Court lacks injunctive power to require compliance with the Town
Code, and
WHEREAS, the Queensbury Town Board wishes to pursue preliminary and injunctive relief,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs Town Counsel to
pursue action in the Warren County Supreme Court seeking:
1. preliminary and permanent relief discontinuing the operation of an illegal junkyard at 19
Newcomb Street in the Town of Queensbury;
2. requiring that the property be brought into compliance with the Town Code and if the
owner fails to do so, allowing the Town to do so and to have the costs charged to the
property owner and made a lien against the property;
3. an award of attorneys fees and costs required by this action; and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town’s Budget Officer to
arrange for payment of any Court and/or litigation costs related to this matter from the account(s) deemed
to be appropriate by the Budget Officer, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs Town Counsel to file any
necessary documentation to commence such proceeding and the Town Supervisor, Town Counsel,
Director of Building and Codes Enforcement and/or Town Budget Officer to take any and all action
necessary to effectuate all terms of this Resolution.

employment proposed to commence on or about June 7, 2011 and to continue for approximately 11 weeks,
and
WHEREAS, funds for such position have been budgeted for in the 2011 Town Budget,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the hiring of Andrew
Hay as a Seasonal Laborer under the direct supervision of the Town Cemetery Superintendent, for paid hours
totaling no more than approximately 11 weeks, subject to the Town successfully completing background
checks as reasonably necessary to judge fitness for the duties for which hired, and drug and/or alcohol
screening, and
BE IT FURTHER,
RESOLVED, that such Seasonal Laborer shall be paid $10.00 per hour as set forth in Town Board
Resolution No.: 57, 2011 and payment shall be paid from the appropriate account, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Cemetery
Superintendent and/or Town Budget Officer to complete any forms and take any action necessary to
effectuate the terms of this Resolution.

items in their respective Departments and the Town Budget Officer did receive lists of items from various
Departments which are considered to be surplus, and
WHEREAS, the Budget Officer advised the various Town Departments of the surplus items and did
not receive any requests from the Departments for such surplus items and therefore has requested Town
Board authorization to sell the surplus items by using auction companies: 1) Auctions International; and 2)
GovDeals, to dispose of such surplus property, and

Discussion held before vote: Supervisor Stec-Again a very generous donation of a thousand dollars we
appreciate that very much from the Community Exchange Foundation for the Q Club Summer Youth
Program. The Q Club is a very popular program, it does a lot of good for all that are involved the younger
and older kids that work there it is one of the nicer programs of its kind in the area and certainly our Town’s
Park and Rec. Dept. is very proud of it. It is nice to see that its work is appreciated by the Community
Exchange Foundation so we thank them.

Queensbury Park and Recreation Brochure Summer 2011 the Town’s Park and
Recreation Dept. have outdone themselves. Reviewed many of the upcoming
items for this summer activities.
WARD II COUNCILMAN RONALD MONTESI

Spoke on the condition of the Bay and Quaker Road garden, met with Chuck Rice
and the Supervisor at the site, will be doing the site over, having more colorful
flowers on the site…
Councilman Metivier noted he would like input on this project.
WARD I COUNCILMAN METIVIER

Noted hydrant flushing will be done during this month, make sure you flush your
washer and hot water heater

Spoke on the So.G.F. Girls on the Run 5K, participated with wife and children
great event 500 young ladies running can’t wait for next year.
SUPERVISOR DANIEL STEC

Relay for Life-John was there, my wife and I and our son were are the event –
what a wonderful event that is…this benefits the entire area the money it raises to
help fight cancer.
