Dear Mr. Ozbay:
During a site plan inspection on September 28, 2005 the following
deficiencies were discovered:
1) Per Condition #1, the two center,flush mounted light fixtures of the
gas island canopy were to be deleted. The approved plans depict 6
fixtures, with the two center fixtures deleted; however, the two center
fixtures have been installed in violation of the approved plans and
Condition`0'. ..
2) The area where the two new dryWells were installed has not been
paved and striped for'the 4 required parking spaces (the site currently
has only 7 of the required 11 parking spaces).

3) The paved swale at the north end.,(adjacent to the north curb cut) has
not been removed and replaced with topsoil and hydroseeding.
4) The north curb cut has not been narrowed and replaced with the new
grass area, which extends north of the missing 4 new parking spaces
and to the east property line.
5) Both.of the curbed islands, have.yet to be topsoiled.and hydroseeded
.and planted;with the four, 3-inch caliper sugar maples (diameter of
the trunk must be 3 inches at 4.5 feet above the finished grade) and
the eight spreading yews (24 inches tall).
6) The proposed grass area south of,the building and parking spaces
has yet-toI'be topsoiled and hydroseeded and planted with thefour
Arborvita (60 inches tall):
7) The-"ONE WAY DO NOT EXIT sign on the north side of the south
State Route 9 curb cut needs to be relocated closer to the per the
plans now that the curb cut has been narrowed.
8) The top (wear) course of paving has yet to be done.

9) The exit and entrance arrows-have not been painted on any of the
three curb cuts (the south State Route 9 curb cut should have the
wording "ONE WAY" painted adjacent to the arrow).
It'is my expectation you will contact this office by October 7, 2005 to
propose. a schedule to correct the above referenced deficiencies.

you have not contacted this department, you are now being directed to
submit a proposed schedule to correct the above referenced deficiencies by
October 24, 2005. The proposed schedule must be submitted in writing,
and is subject to approval by this department. Failure to comply with this
directive will result in an appearance,ticket being issued to you for the Town
of Queensbury Justice Court.
