TOWN BOARD MEMBERS Mrs. Frances Walter-Supervisor Mr. George Kurosaka-Councilman Mr. Stephen Borgos-Councilman Mr. Ronald Montesi-Councilman Mrs. Betty Monahan-Councilman i Mr. Wilson"Mathias-Town Counsel PLEDGE OF ALLEQIANCE LED BY TOWN CLERK — PRESS: WEND, WWSC RESOLUTION ESTABLISHING LEAD AGENCY AND ADOPTING DETERMINATION OF NON-SIGNIFICANCE OF ZONING ORDINANCE CHANGES RESOLUTION NO. 86, Introduced by Mr. Ronald Montesi who moved for its adoption, seconded by Mr. George Kurosaka: WHEREAS, Article 8 of the Environmental Conservation Law established the State Environmental Quality Review Act, and WHEREAS, such act requires environmental review of certain actions undertaken by local governments, and WHEREAS, the Town Board proposes to enact certain changes in the Town Ordinance after a public meeting on March 11, 1986 after hearing testimony and public comment on the proposed changes, and after reviewing the Environmental Assessment Form prepared in connection with the review of the proposed change, and WHEREAS, the Town Board of the Town of Queensbury is duly qualified as ` lead agency with respect to the zoning ordinance changes proposed. NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury is hereby designated lead agency for purposes of SEQRA compliance in the adoption of the zoning ordinance amendment re-zoning certain heavy industrial areas light industry, and be it further RESOLVED, THAT THE Town Board of the Town of Queensbury adopt the annexed notice of determination of non-significance, and that copies of this resolution be forwarded to the Commissioner of the Department of Environmental Conservation and the Region 5 offices of the D.E.C. Duly adopted by the following vote: Ayes: Mr. Kurosaka, Mr. Borgos, Mr. Montesi, Mrs. Monahan, Mrs. Walter Noes: None Absent: None SEQRA NEGATIVE DECLARATION NOTICE OF DETERMINATION OF NON-SIGNIFICANCE This notice is issued pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review) of the Environmental Conservation Law. The Town Board of the Town of Queensbury has determined that the proposed action described below will not have a significant effect on the environment. 1. Title of Action: Amendments to the Town of Queensbury Zoning Ordinance $2cli:inging a zone classification from Heavy Industry 3 acres to Light Industry 1 acre. ?.. SEQRA Status: Unlisted action. 3. Description of Action: To enlarge the areas permitting light industrial uses: The general area proposed is as follows: Re-zone Light Industry Portion Queensbury Tax Map Section 110 - Lower Warren Street, City line and parallel to Quaker Road Detailed maps of the area affected were made available for inspection at the Town Clerk' s Office from February 26, 1986 to March 11, 1986 during normal business hours. 4. Reasons Supporting Determination: Based upon the documents submitted in connection with the application for re-zoning including an environmental assessment form for the proposed zone change, the evidence and public comments submitted at the March 11, 1986 meeting on the proposed action, and upon the knowledge of the members of the Town of Queensbury Board, no-significant environmental effects were identified. The change of land classification from heavy industry to light industry was made in response to several requests for the change by owners of land within the zone. Although, potential density is increased from HI-3 acres to LI-1 acre, the uses permitted under light industry will have less effect upon the environment than permitted heavy industrial uses. _ .Mier, the light industry zone is more compatible with the adjoining zones for highway commercial and plaza commercial activities. 5. RESOLUTION AMENDING ZONING ORDINANCE TO CHANGE CERTAIN AREAS FROM HEAVY INDUSTRY-3A TO LIGHT INDUSTRY-lA IN THE VICINITY OF DIX AVENUE AND WARREN STREET RESOLUTION NO. 87, Introduced by Mrs. Betty Monahan who moved for its adoption, seconded by Mr. Ronald Montesi: WHEREAS, by letter dated February 7, 1986 the Town of Queensbury Planning Board petitioned the Town Board of the Town of Queensbury for a change of zoning of an area more particularly described in Schedule A, and WHEREAS, the Warren County Planning Board approved the proposed rezoning on February 13, 1986, and WHEREAS, no adverse. publ.i.c comment on the issue was received at a duly advertised public hearing, and 33 WHEREAS, the Town Board has made a determination that the re-zoning will have no significant environmental impact, and WHEREAS, the Town Board finds that light industrial uses within the area described in Schedule A is consistent with the purposes and goals set forth in the Town of Queensbury Zoning Ordinance. NOW, THEREFORE BE IT RESOLVED, that the Town of Queensbury Zoning Ordinance is hereby amended to re-zone the area described in Schedule A Light Industry-lA, thereby authorizing all uses permitted under Section 4.020-M of the Town of Queensbury Zoning Ordinance in such area and be it further RESOLVED, that the zoning map for the Town of Queensbury is hereby amended to provide for the re-zoning of such lands described in Schedule A, and be it further RESOLVED, that a copy of this resolution be forwarded to the Warren County Planning Board in accordance with Section 239-M of the General Municipal Law, and be it further RESOLVED, that this amendment shall be effective upon completion of all requirements of the Town of Queensbury Zoning Ordinance. RESOLUTION NO. 88, Introduced by Mrs. Betty Monahan who moved for its adoption, seconded by Mr. Stephen Borgos: WHEREAS, Donald A. Chase, Town Clerk of the Town of Queensbury has heretofore filed his resignation from office in accordance with the provisions of the Town Law and Public Officers Law, such resignation to be effective March 16, 1986, and WHEREAS, a vacancy in the Office of Town Clerk will exist on March 17, 1986 as a result of such resignation, and WHEREAS, Darleen M. Dougher has served the Town of Queensbury with great competence and distinction as Deputy Town Clerk since 1973. NOW, THEREFORE BE IT RESOLVED, that Darleen M. Dougher is appointed Town Clerk of the Town of Queensbury, effective March 17, 1986 to fill the vacancy in such office and to serve in such capacity until December 31, 1986, and be it further RESOLVED, that said Darleen M. Dougher is hereby appointed to the following offices: Registrar of Vital Statistics and access to Public Records Officer, Handicapped Coordinator and Director of Handicapped Parking, such appointments to be effective March 17, 1986, and be it further RESOLVED, that Darleen M. Dougher shall file the appropriate oaths and undertakings in accordance with the provisions of Town Law. Uee who have indicated their support, because they have known Darleen for a great many years and I myself have received a lot of comments from the public that Darleen should be the primary candidate for the position. It is with pleasure are able to vote on such a resolution today. The only sadness is that we are making a change in the Town that we are losing Don Chase, not to far because he was unanimously approved by the Board of Supervisors for a new position this morning.
