Staff Notes for 7/20/21 Town of Queensbury Planning Board Community Development Department Staff Notes July 20, 2021 Site Plan 41-2021 KENT & CHERYL SMITH 379 Bay Road / CI – Commercial Intensive / Ward 3 SEQR Type II Material Review: application, floor plan, elevations, survey, site plans Parcel History: AV 43-2021 __________________________________________________________________________________________ Requested Action Recommendation to the Zoning Board of Appeals for a single story addition of 1,964 sq. ft. that is to be 32 ft. in height. Resolutions 1. Recommendation Project Description Applicant proposes a single story addition of 1,964 sq. ft. that is to be 32 ft. in height. The addition is to an existing building of 1,333 sq. ft. at a height of 28 ft. with a floor area of 2,561 sq. ft. The new floor area is to be 4,525 sq. ft. The use of the addition is for an existing tenant who needs additional area for a multi-use space. Pursuant to Chapter 179-3-040 of the Zoning Ordinance, new commercial construction shall be subject to Variance: Planning Board review and approval. Relief is sought for setbacks. Planning Board shall provide a recommendation to the Zoning Board of Appeals. Staff Comments  Location-The project occurs at 379 Bay Road on a 0.41 ac parcel.  Arrangement- The site has an existing building of 1,333 sq ft footprint and a parking/sidewalk area of 7,611 sq ft.  Building – The addition is to be 1,964 sq ft and a single story building 30 ft in. height.  Traffic- The site has parking for 13 spaces where 9 is required. The applicant has reduced the curbcut area at the front of the property defining the parking area on site.  Site plan overall-  Grading and drainage plan, Sediment and erosion control-the site appears fairly level minimal grading is involved. The project includes eave trenches on either side of the new building, then there is a grass swale areas.  Landscape plan-The applicant had included photos of the buildings and existing landscaping of the building. The remainder of the site appears to be lawn. The applicant has shown there are existing large trees on the site to remain.  Site lighting plan-The plans show two wall mounted lights on the new addition portion facing the road.  Signage-no change to signage is proposed  Elevations-The plans show the elevations of the new building as an addition to the existing building.  Floor plans-The floor plans show the layout in the new building for equipment and storage.   Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, k. topography, q. soil logs, r. construction/demolition disposal.  The waivers requested–Staff finds it reasonable to request a waiver for these items because the project site has an existing building on a fairly level parcel. The applicant has provided information on. n traffic o. commercial alterations/ construction details, p floor plans. Staff would suggest the board request additional information on s. snow removal.  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Nature of Area Variance The applicant proposes an addition to existing building where the rear setback is to be 19 ft 2 inches where a 25 setback is required. The addition is to be 14 ft 11 inches from the north property line and 17 ft from the south property line where a 20 ft setback is required. .
