Project Description
Applicant proposes demolition of an existing/ partial 1,045 sq. ft. footprint home due to a fire to construct a
1,957 sq. ft. footprint home. The project includes disturbances of about 19,786 sq. ft. for site work. The project
includes installation of a new on-site septic system and well. Pursuant to Chapter 179-3-040 & 179-6-060 of
the Zoning Ordinance, construction within 50 ft. of 15% slopes and driveway greater than 10% slope shall be

subject to Planning Board review and approval. Relief is sought for road frontage, setbacks and lot
size. Planning Board shall provide a recommendation to the Zoning Board of Appeals.
Staff Comments
Location-The project is located at 11 Moon Hill Place on a 0.96 ac parcel. The property is located in the
Rural residential 3 acre zoning.
Arrangement- The site has an existing home 1,045 sq ft that is to be removed and a 1,957 sq ft (footprint)
home is to be constructed with associated site work.
Site Design- The new building is located further from the property lines than the original home.
Building – The new homes is to be 1,957 sq ft foot print and utilize the existing driveway area for. There is
to be a basement area, with a first and second floor.
Site conditions-The existing home on site was involved in a fire and a new home and site work are
proposed.
Grading and drainage plan, Sediment and erosion control-The plans show location of the infiltration basin
and the driveway area with some upgrades for access.
Landscape plan-The plans do not indicate information on the landscaping for the new home.
Site lighting plan- The plans do not indicate information on the lighting for the new home.
Utility details-The plans indicate there is well and septic system to be installed on the site.
Elevations-The plans show the elevation views of the home but there are no dimensions as part of the
elevations.
Floor plans-The plans show the basement area, the first floor with the garage and the second floor with the
bedrooms.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, , k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor
plans, q. soil logs, r. construction/demolition disposal s. snow removal
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects. The applicant has provided information on j. stormwater
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Nature of Variance
The applicant proposes a new home that is to be located 73 ft from the front and 100.3 from the rear where 100
ft setback is required; then 89 ft from the North side , 37.5 ft from the South side where a 75 ft setback is
required. Relief is also requested for a lot not having direct access to a public highway (Moon Hill Place is a

Summary
The Planning Board is to provide a recommendation to the ZBA in regards to the relief requested for setbacks
and road frontage.
