BEING the same premises conveyed as follows:
MARGARET F. HANS PORTION
Margaret F. Hans, by deed, dated March 30, 2000, deeded her undivided one-half interest in
the property to Margaret F. Hans, as Trustee of the Margaret Hans Residence Trust, U/A/D
February 25, 2000, which deed was recorded in the Warren County Clerk's Office on March 31,
2000 in Liber 1160 of Deeds at Page 68.
Margaret F. Hans died a resident of the Town of Queensbury, County of Warren and State
of New York on July 10, 2002 and was survived by her husband, Theodore M. Hans. The terms of
said Trust Agreement provided that if Margaret F. Hans died within three (3) years of the
aforementioned transfer, on her death,the Trustee was to distribute all Trust assets to her estate.
The Last Will and Testament of Margaret F. Hans, which was admitted to Probate in the
Warren County Surrogate's Court on April 23, 2003, provided that, if Margaret F. Hans' husband,
Theodore M. Hans, survived her,that the residuary estate be distributed to the Trustee of the Marital
Trust (again, Theodore M. Hans) to be held and disposed of in accordance with the terms of said
Marital Trust. In the event that Theodore M. Hans disclaimed any assets of the Marital Trust, such
assets were to be added to a Family Trust under said Will, to be held and disposed of in accordance
with the terms of said Family Trust. Under the terms of both the Marital Trust and the Family
Trust, Theodore M. Hans was granted the limited power to appoint. by his Last Will and Testament,
the assets of said Trusts to descendants or the spouses of the descendants of Margaret F. Hans;
provided that, if any such appointment was ineffective, that such assets would be distributed to her
descendants then living, per stapes, in further trust pursuant to additional provisions of her Will.
Theodore M. Hans died a resident of the Town of Queensbury, County of Warren and State
of New York on June 11, 2010 and was survived by his children, Theodore M. Hans, Jr., J. Gary
Hans, James L. Hans, Thomas E. Hans and Jackie Brown, who were also the then living
descendants of Margaret F. Hans. By the Last Will and Testament of Theodore M. Hans, which
was admitted to Probate by the Warren County Surrogate's Court on May 2, 2011, he exercised the
aforementioned limited powers of appointment set forth under the Marital Trust and Family Trust
under the Last Will and Testament of Margaret F. Hans. Said Will appointed the balance of said
Trusts to Theodore M. Hans Revocable Trust dated June 16, 2010. Likewise, said Will provided
that the residue of the estate be distributed to the Theodore M. Hans Revocable Trust dated June 16,
2010.
The terms of Theodore M. Hans Revocable Trust Agreement, dated June 16, 2010,provided
that, upon the death of Theodore M. Hans, that residue of said Trust be divided by right of
representation among the descendants of Theodore M. Hans surviving him (i.e., Theodore M. Hans,
Jr., J. Gary Hans, James L. Hans, and Thomas E. Hans) and distributed the Trustees of separate
trusts for the benefit of each descendent ("Descendants' Separate Trusts"), except for the share of
Theodore M. Hans' daughter, Jackie Brown, which was to be distributed to a separate trust for her
benefit ("Jackie Brown Separate Trust"). Theodore M. Hans, Jr., J. Gary Hans,James L. Hans, and
Thomas E. Hans, we each appointed as the Trustee of their own respective Descendent Separate
Trust, and Theodore M. Hans, Jr., J. Gary Hans, James L. Hans, were appointed as Co-Trustees of
the Jackie Brown Separate Trust.
THEODORE M. HANS PORTION
Theodore M. Hans, by deed, dated March 30, 2000, deeded his undivided one-half interest
in the property to Theodore M. Hans, as Trustee of the Theodore Hans Residence Trust U/A/D
February 25, 2000, which deed was recorded in the Warren County Clerk's Office on March 31,
2000 in Liber 1160 of Deeds at Page 65. The terms of said Trust Agreement provided that if
Theodore M. Hans survived more than eight (8) years from the aforementioned transfer, that the
Trust property was to be distributed to the Theodore Hans Family Residence Trust created under
Article XIV of said Agreement, to be administered in accordance with the terms of said Trust. The
Theodore Hans Family Residence Trust provided that, upon the death of Theodore M. Hans, that
the balance of the Trust property be distributed to the children of Theodore M. Hans, per capita. At
the time of his death, Theodore M. Hans was survived by his children, Theodore M. Hans, Jr., J.
Gary Hans, James L. Hans, Thomas E. Hans and Jackie Brown

Cleverdale, in the Town of Queensbury, Warren County, New York, more particularly bounded
and described as follows:
BEGINNING at an iron rod set in the westerly boundary of Gunn Lane, which point marks the
southeasterly corner of lands now or formerly of Sally Gifford, Nancy Geiser, and Richard
Kittredge, and running thence from said point of beginning, South 01 degrees 39 minutes West
along the westerly boundary of Gunn Lane, 90.00 feet to an iron rod set in the westerly bounds
