Queensbury Planning Board
August 3, 1983 8:00 p.m.

The minutes of the July 6, 1983 meeting were approved as written.
SUBDIVISIONS:
Public Hearing - Minor Subdivision No. 2-83
Karl Paulsen - 2 lots off Pulver Road
and on Lake George.
Mr. Leon Steves and Mr. Paulsen present. This application required
two variances which were granted by the Zoning Board of Appeals (not
fronting on town road and lot size). Tests have shown good soils
for in-ground septic system on lot where new two bedroom home to be
constructed. Must meet Queensbury sanitary code standards, N.Y.S.
Health Dept. approval not required. The Building Department is
satisfied that septic requirements are acceptable or possibly ex-
ceed the standards. Mr. Roberts reiterated his concern that in the
future there may be a problem with septic system on lot with existing
home. If that should occur Mr. Paulsen understands and agrees that
he would be willing to install a holding tank. There was no comment
from the public. Mrs. Mann offered motion for final approval of
minor subdivision, seconded by Mr. Dybas. Motion carried unanimously.
RESOLVED: The Board grants final approval to
Minor Subdivision No. 2-83.
Public Hearing - Major Subdivision No. 4-83
Southern Exposure, Robert McDonald, Developer
36 lots Sherman Island and Corinth Roads
Mr. Ray Buckley and Mr. McDonald present. This subdivision previ-
ously granted approval but plans were not filed within the required
time frame. Lot size requirement changed with new ordinance neces-
sitating a re-application and a variance was granted by the Zoning
Board of Appeals for 20,000 sq. ft. lot size. There was no comment
from the public. Two motions were offered for preliminary and
final approval. Both motions offered by Mr. Dybas, seconded by
Mrs. Mann. Both motions carried unanimously.

RESOLVED: Preliminary and Final approval granted
for 36 lot subdivision No. 4-83.
Public Hearing - Major Subdivision No. 3-83 Stonehurst
(formerly Hickory Hill) Charles and Beverly Maine
49 lots east side Ridge Road and south side Sunnyside E.
Mr. Leon Steves and Mr. Maine present. Mr. Maine explained that
name had been changed after talking to residents of area who said that
property formerly known as Stonehurst Farm. An Environmental Assess-
ment Form has been submitted. The Planning Board declared "no
negative impact" and will not require a full EIS. The developer will
work with Mr. Naylor on a drainage plan and present to Planning Board
at next stage. The location of the T at the end of the road will
also be solved. The lots will generally be in excess of one acre.
They will maintain an 8% grade or less and there will be some filling
and cutting. There will be individual wells and septic systems.
No comment from the public. Mr. Sorlin offered a motion for Prelim-
inary approval, seconded by Mr. Dybas. Motion carried unanimously.
RESOLVED: Preliminary approval granted.
NEW BUSINESS:
VARIANCE No. 850 - Donald and Joan Goodsell
north side Clements Road
RR-5A
Mr. and Mrs. Goodsell present. Application to locate a swimming
pool in a side yard in lieu of the rear yard as required. There is
no rear yard. Fenced horse pasture on rear property. Mrs. Mann
offered motion for approval, seconded by Mr. Dybas. Motion carried
unanimously. Goodsell's were told at meeting that they would not
be required to appear at County Board meeting. Mr. Dean will check
and advise Goodsell's if they should appear at County.
COMMENTS: The Planning Board recommend approval of
this area variance. Placing pool in side
yard will not create any hazard or un-
sightly problem for neighbors. Has
¥ractical difficulty as rear yard is
enced pasture property. Pool is 230 feet
back from road.
VARIANCE No. 851 - Bonaquisti Construction Co.
(Freihofer Route Facility)

Mr. Rick Fallon present. Application for addition of 37' x 41'
garage with 26 ft. setback in lieu of the required 50 ft. Mrs.
Mann questioned location of addition and if it could be moved to
the rear. There are gas tanks in rear of building. Mrs. Mann
also questioned the traffic pattern. Mrs. Mann offered motion
for approval, seconded by Mr. Dybas. Motion carried unanimously.
COMMENTS: The Planning Board recommend approval of this
use and area variance. This addition is de-
signed to best accommodate traffic flow and
technical aspects of the building design.
Placing addition elsewhere would interfere
with gas tanks and septic systems providing
practical difficulty. Next door neighbor is
operating a business which makes less than
50 ft. setback more acceptable.
This is an expansion of apre-existing non-
conforming use with no indication of any
problems with the neighbors.
VARIANCE No. 852 - Hess Ventures, Inc.
105 Lower Dix Avenue
HC-1S
Mr. and Mrs. Donald Hess present. Application to construct an
ice storage facility at present business location with 36 ft. rear
setback in lieu of required 50 ft. Mr. Hess explained that due to
the seasonal nature of his business (ice production) he wishes to
build inventory over a longer period of time. Motion for approval
offered by Mr. Sorlin, seconded by Mrs. Mann.
COMMENTS: The Planning Board recommend approval of this
use and area variance. This is an expansion of
a pre-existing non-conforming use. It would be
hardship to move the business elsewhere. Set-
back from residential zone is far less en-
croaching than is existing building. Locating
the addition elsewhere would provide difficulty
in maintaining front and side setbacks. This
will allow best traffic flow on the lot.
