1983-10-04 ~& MINUTES Queensbury Planning Board Tuesday, October 4, 1983 Present: R. Roberts, Chairman R. Montesi, Secretary W. Threw H. Mann J. Dybas R. Noll M. Dean & D. Sealy, Staff Absent: K. Sorlin Approval of the Sepbember 7 meeting and Special Meeting of September 19 mins. was tabled until members have an opportunity to read them. PUD - Top 0' The World - Request for extension of PUD Approval Mr. Roberts read letter from Frank DeSantis, Esq. requesting extension. Motion by Mrs. Mann, seconded by Mr. Montesi to grant extension for 180 days or to April 7, 1984. Motion carried unanimously. SUBDIVISIONS: FINAL APPROVAL - Stonehurst Subdivision No. 3-83 - 49 Lots Charles and Beverly Maine, Developers East Sunnyside and Ridge Roads Mr. Leon Steves and Mr. , Maine present. Mr. Roberts noted that the Board had asked for an extensive storm water drainage plan from applicant and that they would be asking for more than they have in the past with regard to storm water drainage. Mr. Naylor was present and reviewed plans with the Board. He said this plan meets the Town's standards. Motion for approval by Mr. Dybas, seconded by Mr. Threw. Motion carried unanimously. RESOLVED: Final Approval granted for Stonehurst Subdivision No. 3-83. Walter Dombek, No. 7-80 Review of Stehpanie Lane Mr. Tom McCormack present. Developer would like to finish subdivision with duplexes which would reduce building sites by 1. Mrs. Mann noted that duplexes are allowed. Mr. Montesi said that duplexes were not intended at the time of approval and questioned whether this would be objectionable to the residents already established in what they thought to be a single family development. Mr. Dean said there was a question whether it was necessary to come before the Board. Mrs. Mann suggested that they seek advice from Counsel regarding re-subdivision. Tabled unanimously for further advice from Counsel. ¥7 Page Two October 4, 1983 NEW BUSINESS VARIANCE NO. 865 - Myron Rapaport Assembly Point Road LR-IA To construct a single family dwelling with a side setback of 10' on each side in lieu of the required minimum of 10' one side & the total of 30' for the two sides. Mr. Steve Lynn present. Mr. Lynn said that his client had owned property in Maine, had house plans, decided to build on Assembly Point property instead with same house plans. Mr. Roberts said he thought house plan should be designed for property avoiding the necessity for variance. If Mr. Rapaport is unable to have variance he can detach the garage which would put it closer to side property line and still be within ordinance requirement of 5 ft. for garage. Mr. Lynn said this would be less desirabllie from a planning standpoint. Mr. Montesi offered motion for approval, seconded by Mrs. Mann. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this area variance as it is not out of character with neighborhood. VARIANCE NO. 866 - Wendy Savale (Ship Shape) 97 Glenwood Avenue HC-15 Addition to be constructed for storage. (10' x 28') Ms. Savale could not be present. Mr. Eddy asked that Ms. Savale be in touch with him re: beautification. Mrs. Mann offered motion for approval, seconded by Mr. Noll. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this area variance. Good plan use of lot for parking, traffic flow and needs of business. VARIANCE NO. 867 - Herbert and Margaret Kane Fitzgerald Road and on Glen Lake SFR-30 One family year around dwelling located less than 50 ft. required setback from Glen Lake. Mr. Kane present. Present house which is non-conforming will be taken down. Foundation will be used except for one corner. The right-of-way must be maintained so house cannot be moved further back. Septic system will be in rear. Motion for approval by Mr. Montesi, seconded by Mr. Threw. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this area variance based on the following: ~ !Y8 Page Three October 4, 1983 Moving of septic system from 49 ft. from lake to 100-120 ft. Foundation will stay the same with a 2 ft. overhang on the second floor. Good plan for Lake protection. VARIANCE NO. 868 - Robert Seeley Morgan Drive SR-20 Proposed expansion of garage on the east side 12x24' stall with 4 ft. side setback in lieu of required 10 ft. Mr. Seeley present. Garage will conform with present structure. Motion for approval by Mr. Noll, seconded by Mr. Montesi. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this area variance based on the following: Not out of character for area. May improve value of area. Building next door is 30 ft. away from line. No real problem with neighbor. VARIANCE NO. 869 - William F. Chambers south side East Sanford Street LI-IA Singre family dwelling with small office incidental to residence. Mr. Chambers present. Mrs. Mann offered motion for approval, seconded by Mr. Dybas. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this use variance based on the following: Next to a strong residential area. Both home and office would make a good buffer zone between Light Industrial and Residential area. 1'-19 Page Four October 4, 1983 VARIANCE NO. 870 - Gail DeGregorio southeast corner Rt. 9 and Kendrick Road HC-15 patricia Watkins, Esq. and Mr. DeGregorio present. Proposed use 3 apartments in primary building. The property has been for sale for over five years. Two family house unoccuplied for three years, cottage occupied. Mr. DeGregorio owns North Country Auto-Radiator next door. It was suggested that plantings be made along Route 9 although Mr. Eddy said they would have to be salt resistant. Mrs. Mann offered motion for approval, seconded by Mr. Montesi. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this use variance with the recommendation that driveway to Route 9 be st~pped and all traffic use Kendrick Road only. Preexisting use of over 20 years which has not been successful and this would recycle an old building. VARIANCE NO. 871 - John M. Hughes west side Bay Road UR-5 Professional offices to be constructed on Lots 1 and 2 as shown on proposed subdivision of lands of John M. Hughes. Mr. McCormack and Dr. Brassel present. It was noted that there would be no entrances from Bay Road. Motion for approval by Mr. Montesi, seconded by Mr. Noll. Motion carried unanimously. RECOMMENDS: The Board recommend approval of this use variance. This fits the overall plan this Board has had for the Bay Road area. The office buildings will act as a fine goød looking buffer between Bay Road and the residential area behind it. The Board, in response to Mr. McCormack, said they would review the plans for Bellewood and advise Mr. McCormack when it would be on the agenda. ~ø~ Richand Roberts, C airman ----
