1983-11-01 1.50 MINUTES Queensbury Planning Board '- Tuesday, November 1, 1983 Present: R. Roberts, Chairman R. Montesi, Secretary W. Threw J. Dybas H. Mann K. Sorlin R. Noll M. Dean - Staff D. Nealy - Staff The minutes of September 9, September 19 and October 4 were approved unanimously. Mr. Sorlin abstained from approving the minutes of September 9 as he was absent. SUBDIVISIONS: Public Hearing - Subdivision No. 5-83 Country Club Manor, Dan Valente, Developer 6 lots Country Club and Sweet Roads Mr. Tom McCormack present. They have received Health Department approval, no others to be obtained. No comment from the public. Mr. Montesi offered motion for preliminary and final approval, seconded by Mrs. Mann. Motion carried unanimously. RESOLVED: Preliminary and Final approval granted November 1, 1983 Review - Walter Dombek Subdivision No 7-80 Stephanie La:ae Mr. Tom McCormack present. Mr. McCo~mack asked if the Board had received Town Counsel advice regarding Mr. Dombek's request to build duplexes in his partially completed single family development. Mr. Robert's noted that their use of Town Counsel had been restricted due to budgetary constraints. Mr. Robert's said that he was opposed to the duplex plan and Mr. Montesi added that he felt it would be unfair to the people already there. Mrs. Mann inquired about deed restrictions and some of the neighbors presented their deeds containing single family dwelling restrictions. Mr. John Cross presented a petition from residents of Stephanie Lane and Pinewood containing 37 signatures opposed to the duplex plan. Mr. McCormack said that he thought Mr. Dombek would be violating his own deed restrictions and withdrew his request. Extension of time for Bellewood Park Subdivision, Enoch and patricia Zylowski, Developers - 12 lots on Assembly Point. Mrs. Mann offered motion to approve extension, seèonded by Mr. Noll. Motion carried unanimously. RESOLVED: The Board approved a resolution to extend the time for filing final application and plat to January 1, 1984 for time to come up with all the permits. /S I Page Two November 1, 1983 NEW BUSINESS: -- Site Plan Review No. 19-83 - Phyllis M. Holtz UR-5 The Woodlands West Mountain Road (Rush Pond) To construct six (6) multi-family bui1dings with four (4) dwelling units in each in a UR-5 Zone on the property situated on east side of West Mountain Road approximately 1600 ft. south of Gurney Lane. Mr. Stephen Lynn, Mr. Frank Walter (Consulting Engineer), Mrs. Holtz present. Mr. Lynn presented the proposal for the 5~ acre parcel. Mrs. Holtz owns a total of 62 acres. There will be a 50 foot buffer around entire development, leaving trees along West Mountain Road. Ideal conditions for septic. Mr. Sorlin questioned proximity to stream and Rush Pond. Mr. Walter said he was confident there would be no problem based on perc tests, flow of undergound water and water table. Construction of the road and water lines was discussed. Mr. Jim Davies, Esq. representing Ràbbi Lansbury of New Jersey, owner of property on Old West Mountain Road - client feels this will have an adverse affect on property values. Several neighbors examined the plan, no one spoke against it. Mrs. Holtz said these would be luxury apartments. Applicants appeared before the Beautification Committee and the committee approved plans for landscaping. Mr. Montesi offered motion for approval, seconded by Mr. Dybas. Motion carried unanimously. County Planning Board approved. RESOLVED: The Board granted this Site Plan with the following stipulations. 1. Redo map to include access road within property line of development. 2. Maintain 50 ft. buffer zone of trees on West Mountain Road. 3. Road and water line to be buil~ to Town standards. Site Plan Review No. 20-83 - Jan Bishop west side Ridge Road SR-30 To operate a professional office incidental to duplex dwelling in SR-30 zone one the property situated at the west side of Ridge Road approximately 300 ft. south of Cronin Road. Jan Bishop and Mr~ Robert Joy, Architect present. Ms. Bishop intends to renovate and restore two family dwelling for herself and her mother. She will also conduct her business, Diagnostic Learning Center from this location. Mrs. Bishop presented a petetion \from her present neighbors in Glens Falls and her new neighbors on Ridge Road stating no objection to the proposal. Several neighbors appeared including Clarence Elms, who were of the impression that Ms. Bishop intended to build duplexes. The wording of their notices was confusing and /5"1- Page Three November 1, 1983 when apprised of the actual proposal they eMpressed no objection. Motion for approval by Mr. Noll, seconded by Mr. Threw. Motion carried unanimously. County Planning Board approved. RESOLVED: The Board granted approval of this Site Plan Review as there will be no adverse effect on property or area. It is the intent of the applicant to improve the home. VARIANCE NO. 872 - Northland Beverage Center souths ide Quaker Road HC-15 To place an addition with less than the required 20 ft. side and rear setbacks in Highway Commercial. Mr. Jack Minnick present. Due to the enactment of the bottle bill, additional cold storage is imperative for Northland Beverage. Can- not buy the property behind because Mr. Nolan has leased for two more years from Millbrook. Mr. Montesi offered motion for approval, seconded by Mr. Noll. Motion carried unanimously. COMMENT: The Board recommend approval of this area variance. From the point of view of the Planning Board we see no problem and applicant can show practical difficulty - "the bottle bill". VARIANCE NO. 873 - Janet and Charles Bolivar (Brown's Motel) HC-15 East side Route 9 - 53 Lake George Road To relocate motel units with 4 ft. setback in lieu of the required 20 ft. rear setback in a Highway Commercial 15 zone. Mr. and Mrs. Bolivar present. It was noted that there will be more permeable soil as a result of this improvement. Mrs. Mann offered motion for approval, seconded by Mr. Dybas. Motion carried unanimously. COMMENT: The Board recommend approval of this area variance. This setback will back up to a heavy equipment operation and in its way hide this operation. Providing a U turn driveway will make for a safer drive through. VARIANCE NO. 874 - David and Rosemary Richardson Eagan (Egan) Road - Big Bay Area LI-IA To place a mobile home on a 4ilacre paz:rcel in Light dndustrial 1 Acre Zone. Ms. Denise McLaughlin, Esq. and Mr. and Mrs. Richardson present. Applicants own ten acres, log home on property. Want to split and put mobile home on one piece. They have owned property for years. IS3 Page Four November 1, 1983 - Mr. Sorlin is opposed to increasing residents in a Light Industrial Zone. Ms. McLaughlin noted that they had already attended two Town Board meetings and received approval from Town Board for mobile home. Mrs. Mann feels that this preexisted and that they have a right to divide their property. It is very close to residential area and part of it may be in residential. Mr. Roberts suggested that they re-check zoning maps. Mrs. Mann offered motion for approval, seconded by Mr. Montesi. All voted in favor with Messrs. £o~lin, Roberts and Dybas voting no. Motion carried. COMMENTS: The Board recommend approval of this use variance as preexisting our new zoning plan) the applicant had a home on this property. VARIANCE NO. 875 - James Gargiulo Pulver Road and on Lake George LR-IA To remove existing 6 bedroom residence and replace with 5 bedroom single family dwelling with an average 50 ft. setback from lakeshore. Mr. Stephen Lynn present. Mr. Montesi offered motion for approval, seconded by Mr. Threw. Motion carried unanimously. COMMENTS: The Board recommend approval of this area variance as new building will be no closer than the old to the lakeshore. Septic will be pumped up the hill and is no problem to bhe lake. VARIANCE NO. 876 - James E. Bombard, Sr. east side Martindale Road SR-30 To conduct a car refurbishing business in Suburban Residential zone. Mr. Bombard present. Mr. Sorlin noted that he is opposed to this type of variance approval from a planning standpoint. Mrs. Mann offered a motion for approval, seconded by Mr. Dybas. Messrs. Sorlin, Roberts and Montesi voted no, the rest of the Board in favor. Motion carried. Mr. Dybas commented that he usually is not in flavor of this type of variance but knows Mr. Bombard personally and feels that his business will not be a detriment to the area. COMMENTS: The Board recommend approval of this use variance for the following reasons: Owner will live on property. OWner will run business. This is an isolated area of Town. OWner owns both lots and will be considered as one lot. Operation will be conducted within the building. ~~ Page Five November 1, 1983 VARIANCE NO. 877 - Sager Spuck Supply Co., Inc. 131 River Street Hi-3A To place a free-standing sign with zero setback from front property line and 4 ft. setback from side property line in lieu of the required 15 ft. setback. Mr. Robert Platt (Signs of Progress) and Mr. Jeff Underhill present. There will be no advertising on sign, this is a heavy industrial area. Mr. Montesi offered motion for approval, seconded by Mrs. Mann. Motion carried unanimously. COMMENTS: The Board recommend approval of this sign variance. Has shown hardship as to driveway, roadway, tree and building presents a blocking of view. VARIANCE NO. 878 - John R. Pyle, Jr. Mason Road, Oleverdale LR-IA To replace existing garage with garage with larger total square footage at the same 7 ft. setback from Mason Road. Mr. Joe Roulier present. This would not obstruct view of lake, no residents on either side. Increasing cubic footage not square footage. Mr. Montesi offered motion for approval, seconded by Mr. Threw. Motion carried unanimously. COMMENTS: The Board recommend approval of th~s area variance as new garage will be no closer to roadway than or~ginal building. The only difference is height and bulk of building. No view to be affected. VARIANCE NO. 879 - Hans A. Hansen Seward Street UR-IO To operate shop for repair and sale of household appliances. Mr. Malcolm O'Hara, Esq. present. Mr. Hansen wishes to construct a 40x50 foot building for use as an accessory structure for the repair of appliances, some sales incidental to that. Mr. Hansen said his immediate neighbors have no objection. Mrs. Mann noted that with the exception of Sherman Avenue this is residential area and there is already debris on the property. Mr. Montesi said they would be creating a non-confòrming lot with the purchase of land from Mrs. Washburn. Mrs. Mann offered motion for disapproval, seconded by Mr. Sorlin. Motion carried unanimously. /55' Page Six November 1, 1983 ",-- COMMENTS: The Board recommend disapproval of this use variance. There is tight grouping of homes in this area. This would cause traffic problems and trash in a residential area. It would also, as presented, create a non conforming lot for Mrs. Washburn which is not legaJt. She would need 10,000 sq. ft. VARIANCE NO. 880 - Cumberland Farms Corner Route 9 and Kendrick Road HC-15 To install 48 inch by 66 inch gas price sign on existing sign pole. Mr. Dennis McCue present. Mr. Montesi offered motion for disapproval, seconded by Mr. Noll. Motion carried unanimously. COMMENTS: The Board recommend disapproval of this sign variance. To be fair and consistent we would like to see one sign for prices and this ~ign to be 10 or 12 sq. ft. To be fair to others a sign one-half the size requested for this variance would be fair to all. VARIANCE NO. 881 - Michael Doniguian west side Route 9 HC-15 Withdrawn VARIANCE NO. 882 - Douglas Helffrich east side Ridge Road SR-30 To construct addition to rear of auto repair garage. Mr. Helffrich present. seconded by Mrs. Mann. Mr. Sorlin offered motion for approval, Motion carried unanimously. COMMENTS: The Board recommend approval of this use variance for expansion of existing non- conforming use. This is a reasonable expansion of a nonconforming use. ~4;: ~.
