1984-01-05 /(,/ MINUTES Queensbury Planning Board Thursday, January 5, 1984 8:00 P.M. - Present: R. Roberts, Chairman K. Sorlin, Acting Secretary J. Dybas H. Mann B. Threw R. Noll M. Dean - Staff Absent: None SUBDIVISIONS: Bellwood Park Subdivision (Zylowski) Tom McCormack present. Mr. McCormack said they have the necessary permits from the NYS Health Department and DEC. and requested that this subdivis~on be put on next month's agenda for final approval. The previous deadline had been January 1, 1984, Bill Lamy of DEC accepted responsiblity for material being late. By roll call vote the Board unanimously agreed to put on agenda for February. NEW BUSINESS: SITE PLAN REVIEW #23-83 - John and Anthony Brock HC-15 west side Route 9 - 700 ft. south of Rt. 149. To operate a boat sales, service and storage ,in a Highway Commercial 15 Zone on the property situated on the east side of Route 9 approxi- mately 700 feet south of Route 149 (former mini mall) . John and Anthony Brock presentlowners Scotia Marine). The three stores on south side will be for boat sales, service and storage. The balance will be rented. Gas station will remain. ROW still exists to HiWay Host, also 34 foot ROW to property in the rear. In the future they plan to buildia service building. The Warren County Planning Board recommended approval. Mr. Sorlin offered motion for approval, seconded by Mrs. Mann. Motion carried unani- mously. RESOLVED: The Board approved this Site Plan based on the following: 1. Fits in with zoning. 2. Good recycling of existing buildings. 3. No adverse effect on neighborhood or traffic. '-- I&~ Page Two January 5, 1984 -- SITE PLAN REVIEW #24-83 Kentucky Fried Chicken Route 9 Northgate Center PC-lA To operate a restaurant with a drive-thru window on the property situated at Northgate Shopping Center, Route 9. Mr. Byron Rist, Mr. Jim Mathis present. The only major change in the already existing restaurant will be the outside drive-thru. The dumpster will be enclosed, the present markers in driveway will be made more attractive. Warren County Planning Board recom- mends approval. Motion for approval by Mr. Dybas, seconded by Mr. Threw. Motion carried unanimously. RESOLVED: The Board approved this Site Plan based on the following: 1. Recycling old building. 2. No effect on character of neighborhood. 3. No adverse effect on traffic flow. VARIANCE NO. 890 - Daniel R. and Barbara L. Barber west side Bay Road adjoining Sherwood Acres subdivision SR-30 Mr. Mike O'Connor, Esq. and Mr. Barber present. Building permit has been issued and foundation of duplex has been constructed. Details of comments âttached to Application to Zoning Board of Appeals. Mrs. Mann offered motion for approval, seconded by Mr. Noll. Motion carried unanimously. RECOMMENDS: Approval even though lot is too small, because land is contiguous to a subdivision of record and we feel it cannot be altered even though it is in the same ownership as the land in question. Also, a building permit has been issued and the foundation for the duplex has already been constructed so a hardship exists.
